Pressler and Pressler sent me an alleged judgement order with subject: RE: Palisades Collection, L.L.C. from the Civil Court of the City of New York. The amount being asked for is $3,423.89.

On Friday October 25th, 2006, my bank accounts were seized in an amount exceeding $6,000.00, which is twice what the papers have on them.

In addition, I was sent a questionnaire asking question concerning bank accounts, cars, residence, real property, etc.

There was NO agreement attached showing that they had purchased my debt from anyone else. And I am wondering why the amount is twice what was asked for in the so-called judgement.

Any help would be greatly appreciated.

Annie,

Sorry to hear what happened to you, but it is all too common, and they get away with it because victims do not follow through with lawsuits and criminal charges.

FYI...A debt collector does not need your consent to pull your credit. It is called "permissible purpose" under federal law, and it is automatic if you have a collections account on someone, whether it is actually valid or not is not an issue, yet.

NEVER speak to ANY collector on the phone!!NEVER!!!It will never do anything positive for you, and will always make the situation worse for you. Guaranteed.

Communicate only by certified mail, return reciept requested. Put the certified# on the letter itself, and keep a copy for your records.

As far as the money they got from your account, here is what you do. Get every piece of paper available from both your bank and the court. I can guarantee that they violated some law or falsified some document to get that garnishment order.

And, if this is the case, you can vacate the judgement, sue them for damages, and file criminal charges on them. Not to mention getting them disbarred by filing a BAR ASSOCIATION complaint on them for illegal and /or unethical behavior.

Here is what they did. They pulled your credit and found an old address that they know you are not at. They "serve" the summons to that address to get "good service". Then when there is no response by you, they get the default judgement on you which they take to your bank to get your money. This practice is illegal, but common.

Get a lawyer ASAP whether you can afford it or not. You will win, and you will get your money back. DO NOT let them get away with this criminal activity.

I am getting a lwyer and i am gonna sue those sob's b/c they obtained a copy of my credit report without my consent. They are also alleging i had a citibank card in 1995 which i never had and when i called them they couldn't tell me anything. They really deserve to rot in hell. I also contacted 7 on your side and am waiting for a response back from them b/c i want to publicize these scam artists for the scum they are.
