My vehicle was involved in an accident over 5 months ago. I took my vehicle to the collision shop for repairs. The work was not done. A check was sent to the collision shop. I was to sign the back of the check and endorse it to the collision shop. I was not made aware of this by either the collision shop or Progressive. My name was miss spelled on the claim and on the check that was sent. The collision shop forged my name in order to cash it.
The work was not done and I was told to come pick my truck up or they were going to sell it. I went back to Progressive who told me to fill out a fraud form because I did not sign the check. I was told it would take no more then 8 week to get the money back. It has now been 5 months and Progressive is telling me to wait longer. I have called them several time during the waiting period and they only do something on my file when I call. I paid for this insurance company to protect me and my interest and repair my vehicle. I feel like I am fighting two companies. Progressive and the Collision shop trying to get the work that was promised to be done.
At the end of the day. The Collision Shop commits fraud and Progressive does not care about there customers. But let us not up hold our part of the contract. They will cancel our policy.

Pick a quality collision shop

The responsibility is on you as an individual to select the best place to have your vehicle repaired.
The fact that you picked a collision repair shop that does not do timely work and commits check fraud is your fault. The auto insurance company is not to blame.
The answer to your problem is simple:
1. File a fraud claim with your State Attorney General (just as the insurance carrier suggested).
2. Pick up the truck and have it fixed somewhere else (at your own expense)
3. Get a rental vehicle (at your own expense).
4. Request reimbursement from the insurance carrier for cost of repairs incurred at the new shop
5. Sue the collision repair shop in small claims court for loss of use (rental car expense)
6. Add to line 6, the check money they stole if not already returned
OR
1. Pay nothing out of your own pocket
2. Wait months for insurance company to try and investigate and sort out what happened.
I understand your frustration, however to blaming Progressive is a stretch.

What can Progressive really do? If they send a check with your name on it and another company name on it, and it gets "cashed" but your name was forged, what is there left for them to do? They have paid their money, and at the very least they have given you the fraud paperwork to fill out. After that, its not up to them. Its up to the courts, banks, whomever else, to find a way to get back your money. They can't pay you again until they are reimbursed. It's not like they would want to wait to be reimbursed. They have no vested interest in waiting as they may lose a customer and could be out the money in the end, still oweing for some repairs. This can't be blamed on Progressive. You may need to do some extra work on your own as this was the shop you chose. This is why Progressive (and most other insurance companies) have network or direct repair shops that they trust so this type of tying doesn't occur.
