Automotive Financial Corporation KAR Auction Services, ADESA, PRENOVOST NORMANDIN, BERGH & DAWE, Tom Roddy Normandin Predatory Lender, Unlicensed Loans Internet

California Department of Justice received a complaint regarding loan-sharking and unlicensed lending by Automotive Finance Corporation (AFC). A complaint was filed 12/10/2009 alleging that AFC made more than 500,000 loans in violation of California usury laws.

AFC, a flooring lender for used car dealers, provided false information to the Department of Corporations when they submitted an application in January 2007. AFC claimed they had just formed a new corporation, AFC CAL LLC, on 1/23/2007 according to documents submitted by attorney-in-fact Mark T. Gillett.

AFC falsely stated that all loans were commercial and for at least $5,000. This deception allowed AFC to bypass laws that required many of their loans to be classified as personal. Interest rates on loans for as small as $1,000 could exceed 500%, in violation of the California Constitution.

Santa Ana attorney Tom Roddy Normandin has represented AFC for ten years. In more than one hundred lawsuits, AFC has posed as a licensed lender and obtain judgments. Licensed car dealers were shut down by an unlicensed lender.

Tom Roddy Normandin also represents Dealer Services Corporation, another lender that was unlicensed in California while making 100,000 loans.

Both AFC and DSC have used "Roddy" as their means for destroying small business throughout California.
