I recently moved into an apartment @ 88 Lembeck Ave on the 1st floor. The apartment is very nice and although I found the rent to be on the high side my husband and I both decided to go with it because it was in a nice area and we both loved the apartment. Once we moved in it became know to us that the landlord was residing in an illegal apartment located in the basement of the dwelling (Which is a two family home) and that his utilities were connect to ours a fact that he failed to mention to us.

While in the hallway of the home I was speaking the the tenant how resides upstairs from my apartment and she let me know she was moving and was telling me all sort of things about the landlord, he came knocking on the door apparently after easedropping on the conversation we were having. He proceded upstairs to her house to have a conversation with her regarding her moving and then came back down to my apartment and knocked on my door and informed me that he was contacting his lawyer to void the rental contract the we had entered into for 1 year.

His reason he told me that I could not talk to the tenant upstairs. I was appauled that he thought he could control who I spoke to and informed him that he could contact his lawyer and I would also contact mine. I spoke with him today (1/24/06) and he informed me that the lease would be voided and I requested that it be provided to me in writing and he informed me it would be.

Please to all that are trying to rent from this individual BEWARE.

These tenant moved in the apartment but did not provide the truth about their previous residence. They indicated that they lived at one addressed which when i made a surprise visit I found out that it did not look like their apartment and Found out later that they used their grandmother or aunts house fabricating it was thier address. I later found out on my way to the office on the day the tenant was moving in that their apartment was located in the Housing Projects. Further there employment was not permanent which i was told by them that is was. I found out they work for temp agencies.

The tenants on the second floor moved because I increased their rent. I did find them speaking to the new tenants, however the next three days I found out to much iformation about these tenants that gave me the belief that these tenants were trouble. They broke into the basement of the house and left garbage in the apartment on the day they moved out. I contacted my attorney, eviction papers were filed and as court ordered there removal. (This is my house and I have a right to rent to whom ever I choose). The tenant were offered by me to return thier security deposit, rent for the 1st month and I offered to pay for the unhaul truck to remove their funiture. All in cash!! So they can leave right away.

As the owner of my property I can live anywere I wish within my house. Yes its a finished basement and its not illegal as long as i use it for my personal use. I did not have a problem with them moving out from the projects to make something better for their quality of life, however I do have a problem when the application they provided was false and the tenants were not truthful about their history. My house is 1,600 dollars short of a half million dollars and I do not intent to have it rented to anyone who does not respect telling the truth and taking care of the property in which I have sweated and labored so hard to obtain. I am more than happy to speak to any person and give them my attorny's information to speak further in this matter.
