RSC Transport, Inc. of L.A., Calif. being a licensed and bonded freight brokerage in the transportation industry, is not recommended by us for doing any business whatsoever, for continuously lying, failing to admit fault, and neglecting to reply to emails until they were presented with an invoice for the balance of $250.00 for a TONU (truck-ordered-not-used,) which is an industry standard when a trucker/carrier signs a rate confirmation that obligates him/her to fulfill their commitment to provide a service between the shipper and the receiver.
RSC Transport, Inc. and Iron Mountain Iron & Equipment, LLC, a family owned and operated American business entered into an agreement under contract to load a bulldozer at a Caterpillar dealership in Fayetteville, North Carolina on 12-3-2020. Upon initial booking of this load, RSC Transport, Inc. was asked a minimum of THREE times if this was a LEGAL width load...which is 102" according to Federal Regulations. They responded each time with a YES. Me being in the industry and also in the heavy equipment operating and owning many types of machinery over the past 35 + years, questioned this because the load was a Caterpillar D5K dozer, which would traditionally be 10' 2" wide at the blade, and would have to be permitted in each state to travel oversized to New Hampshire. After several replies from RSC that this was a legal load, I was under the impression that the blade had been removed and was indeed not wide at this point.
A total rate to haul this machine is predetermined upon signing the rate confirmation, but due to RSC's lack of proper dimensions and knowledge of this industry, caused Iron Mountain Iron & Equipment, LLC to spend their time and money driving 3.5 hours from Aiken, SC to Fayetteville, NC and then spend another 3 hours on site before having to forfeit this load altogether. Normal rate charged would be at $110.00/hour. We are only seeking the industry standard fee for a TONU of $250.00, but RSC still fails to acknowledge their misrepresentation of the dimensions on the rate confirmation, and refuses to pay this small fee. We are now in the process of collecting this fee by all means necessary.
Upon arrival to the shipper, I immediately saw the machine was too wide to haul legally. It took 2 hours to just get the proper release form from Danny at RSC to be able to access this machine on 12-3-2020, and then 3 additional hours to try and decide what to do. My idea was to remove the blade and put it on lengthwise so it would not be wide. The buyer in New Hampshire declined, due to cost of removal. The result of this was a complete loss for IMI, LLC and therefore had to leave the premises and sat an additional 2 days looking for an alternative load to get the truck back to New England. That equates to another loss of $1,000.00 per day for each day the truck is not running. We're looking for $250.00...so this is quite a bit less than the loss incurred, but we feel that we have to hold RSC accountable for their negligence, and we are taking every possible action available to make it be known that they are not very trustworthy or very knowledgable in the heavy equipment transport business.
In addition to our story, the buyer of the machine himself, in our several conversations that we had between ourselves waiting for "Danny" at RSC to respond to our calls that morning, stated that he was very disgusted with Danny and RSC due to their continuous lying about getting this machine from NC to NH. The machine was supposed to be delivered a week prior, but RSC kept coming up with excuses about it and lying to the buyer about the pick up dates, times, etc. as a lot of brokers do. I can verify that at any given moment with a call to the buyer in NH, which I know personally. So the buyer whom initially set up this move with RSC, Inc. is also disgusted and done with them as well.
I have petitioned RSC transport, Inc. SEVERAL times very professionally via email to Danny directly, that if they do the RIGHT thing and pay us this nominal fee of $250.00...this all goes away instantly. They for some reason continue to deny any wrong doing on their parts, so we will continue to seek restitution until the debt is satisfied in full. They keep claiming that they don't pay TONU's...but we don't CARE what they say, we did everything we were requred to do and then some...so we will be continuing this collection process until it is paid in full. Supporting documentation, emails and text messages have been retained for our records.
In closing, I will emphasize again that RSC Transport, Inc. is NOT qualified to be a broker of heavy equipment. Maybe stick to dry freight...it's much easier.
