I have been employed with this company since 1988. They have always tried to be and handle all calls with proffessionalism. If they hire someone who doesn't follow the law they terminate them. If anyone has a complaint about RSI in Tamarac please do not hesitate to call me (Jack Thomas) Thank You!

You were right.. There is nothing the Attorney General can and will do.
I received a letter for the Attorney Generals office showing me that RSI is desputing my complaints. They claimed there was no harrassment or abuse involved!!
When I mentioned to the Attorney General that I was scared @ these call RSI stated. "I never told them I was scared"... DAHHHHHHHH... like I'm gonna tell them that! They also said I PROMISED to pay them 5 dollars a month. (which I never did) I just said I only have about 5 dollars a month xtra to live in.
I have a log that shows they have called me over 20 times for this debt. But it didn't include in the letter what the rep from RSI stated. He said "B*tch how can you walk around knowing you have this bill and not pay it. To me that's "ABUSIVE". of course he/they are not going to admit their faults!!
Any suggestions out there??

Star,
The agency responsible for enforcement is the FTC, but they don't do any individual enforcement. They wait until they get a certain # of complaints, then they investigate and/or file charges or lawsuit.
The FDCPA can only be enforced by an individual i court. You must sue.
The primary function of the AG's office is to provide advice and legal representation to other state agencies. They do have divisions for consumer protection, but only in the capacity of an arbitrator. They cannot represent you on an individual basis by means of enforcement actions.
Document everything, and stay off the phone! Do everything in writing by certified mail, return reciept requested.
Relax.

Star,
This is very easy to stop. And there is absolutely nothing they can do to you. They cannot take anything and they know it. This is why they terrorize you, to get you to pay them voluntarily. They have violated several state and federal laws already.
And, there is nothing stopping you from recording the calls. Once you tell them you are recording, it is on them if they choose to speak or call back. And, there is no criminal penalty for violating the 1 party consent in PA. It is a civil matter. They would have to sue, and prove damages. I lived in PA a total of 15 years.
First, you need to go to the FTC website at ftc.gov and read and print out the FDCPA. They have violated your rights, threatening the siezure of your car, and checking account funds, as they cannot do this. They also violated by calling you derogatory names and being abusive. These violations are each worth $1000 to you in civil court. Record all conversations for evidence. Tell them you are recording every call.
File online complaints for each violation of your rights under the FDCPA.
Now, write a CEASE COMMUNICATIONS letter as per your rights under the FDCPA where you specify that they are not to contact you any further for any reason by any means other than to tell you specifically what action they are taking against you or that they have ceased collections action.
Send this letter by certified mail, return reciept requested. Be sure to put the certified# on the letter itself and keep a copy for your records.
NEVER speak to any collector on the phone. Do not even answer blocked calls.
Call your phone company and file a complaint of harassment, and also make a police report. If you are over the age of 65, they are violating an elderly abuse law also, which is a felony.
These collectors are obviously amateurs as they are not yet listed on budhibbs.com. File a separate ftc complaint online each time they call as it is the number of complaints that bring harassment.
Good luck and RELAX!

When he calls I ask him for certain information which he refuses to give me. He also responded that he has my cell phone number (which isn't my phone) and he called me on that.. he replied see bit*h now you know i'm not fooling around.. He told me he will take my car, tap into my checking account, take what ever I owe to pay this debt. I asked him for the account information, the original creditor, He said well if you would have paid it you would have it.. I told him not to call me again, he replied I will call you when I want as many times as I want till this debt is paid!!
I really am scared... I'm a survivor from brain surgery and I'm disabeled!!!
But it's against the law to record phone conversations in my state
Anyone with more suggestions PLEASE HELP!!!
THANK YOU

Here is a way to get rid of those Scum Sucking Parasites!!!
18 questions that will stop debt collectors abusive phone calls
Are you being hounded on the phone by debt collectors? If so then the following 18 questions are for you.
They will put an end to their abuse very quickly. When you use them you should always be certain that you demand that they validate the debt and inform them that you dispute the debt and each and every part of it. You should print them out and put them in a plastic sheet protector and keep them near your phone so you can get to them quickly.
You should also tape all of your phone calls with debt collectors and I will also show you how to do that here.
1. What is the name of the company you are calling for?
2. What is their address.
3. What state are they in?
4. What is the zip code?
5. What is the phone number?
6. What is the name of the creditor?
7. What is their address?
8. What state are they in?
9. What is the zip code?
10. What is their phone number?
11. What is the Account number?
12. What is the amount you claim I owe?
13. What is your name? What is your last name?
14. What is your address?
15. What state are you in?
16. What is your zip code?
17. What is your telephone number?
18. What is your Social Security number?
Naturally when you get down to the personal information they are going to want to refuse to give you that information and will claim that they don't have to give you that information. That is when you tell them that they must give it by law because the law says that they have to give full and complete information about the call they are making and since they have already broken the law by calling you in the first place and you want to know where to send their summons to court and you want to be sure that you have the right person on the summons. That will normally get rid of them real quick. If it doesn't then you simply tell them that if they have anything to say to you they need to put it in a letter and send it to you by mail and then hang up on them. If they start screaming at you then you simply scream back at them and don't shut up until they do. Naturally you will not want to take the time to go through all of that at your workplace but if they do get stupid and call you at work and on your cell phone then you simply get their name and the company name and tell them that you are at work and they need to put it in writing and send it to them. But you want to put your home and cell phone numbers on your letters and make it easy for them to break the law. You have to have several violations of the law in order to win the case and you have to build a paper trail of the violations so we want to tempt them to break the law as many times as possible. Enjoy!!
