I brought my car into a repair shop for a very minor issue. The repair shop contacted Secured Capital Management about the issue with the car. SCM then opened a claim on the car and told the repair shop to call them in the morning because they were closing for the day. This was not third party information since the repair shop was on speaker phone when they called it in and I was standing in the office. So that night I took the car home (the shop had already said that the part would take 6-10 days to get in). The next morning I got a call from the shop saying that the warranty company (Secured Capital Management) would not pay on the claim. I called them up and followed up with a letter. The reason why they would not pay the claim - The vehicle must remain at the repair facility for the enitre duration of the claim. I told them that I was willing to meet their adjusters / estimators at any time or any place if they wanted to look at the car. They simply said that their policy is to close a claim as soon as the car leaves the shop (this is in writing). The big problem that I have with this is that no where in the contract does it say that the car must be at the shop nor did the original adjuster say anything to us when opening the claim.
an excerpt from the contract under "What you must do"
"Your vehicle must be at a repair center in order for a claim to be opened. Once the vehicle is at the repair center, you are responsible to have the repair center call Secured Capital Management at (800) 292-2750 with the estimate of repairs before any work begins. The service contract holder is responsible for all charges relating to the tear down and diagnosis of the vehicle. If it is determined that a covered component has failed and the estimate for the repairs is agreed upon by our adjuster, an authorization number will be issued by us for the repair. ....."
So in summary don't buy from them they do not follow their contracts to the letter that they were written. I welcome a reply from anyone at Penn Warranty or Secured Capital Management

You're absolutely right! According to the terms of their own contract, you did not violate one single thing. Sue their butts off! anyone (especially a Judge) with a logical mind would have to agree with you.
