My realtor submitted my cash offer/Sales agreement to Sergio Betancourt  for a home purchase.  After speaking to him he reassured my realtor that the seller had agreed and would return an executed contract the next day.   The next day he would not answer his phone and it took many calls to get a call back.  He then told my realtor that he was sorry but that the seller had decided to accept someone else’s offer.  I then decided to call the seller myself and spoke to her.  She was a very nice lady that told me that Sergio Betancourt, her realtor had told her that she was not allowed to sell me the house because he had to sell it to someone else that he told her had placed an offer months before when the house had gone up for sale previously.  The seller told me she would have loved to sell the house to me but it was out of her hands.  Sergio, her realtor had his own agenda to make 6% commission and not share the commission with my realtor. He was unethical, conniving, deceiving, and an outright liar.  

I would never do any business with such a crooked realtor who does not look out for his customers, but just looks for his own personal benefit.  I wish the DBPR will investigate his business ethics as I’m certain I’m not the only one who has been cheated by him.

The seller does have the right to decide what offer they accept or don't accept so they are not helpless.  While people do often try to contact the seller, one does have to wonder how exactly you got their information.

There is really no way the Realtor would have a signed contract from a previous offer a month prior without the owner knowing.

So this leads to a couple of possibilities. It is possible that the Realtor did lie to the Owner to get her to take a higher offer. I don't doubt that she was a very nice lady, as if that was me and you called up wondering why I didn't accept your offer I would probably would have wondered how you got my information and ended the call.   But she may be a very nice lady who decided to accept a higher offer and lied about the reason.

You of course are going to believe the seller because the realtor was trying to protect his higher commission. Just remember that the seller also is going to get more money out of the deal as well so they do have some motiviation.

I am not calling the seller a scammer, and doubt she is. But the best scammers are the ones who come off as being able to lie to your face while appearing very "nice". So in terms of plausability the realtors story actually would make more sense. Where the seller just decided to take a better offer.
