Shiller Vision Center DR. Alan Dale Shiller Mislead me & failed to honor a signed contract for Lasik Surgery that I paid $3800. Palestine Texas

They have failed to provide or contact myself about the service I paid for ever! They have continued to lie & make false claims to try to get out of the fact that they didn't provide the service that was paid for within a years time. I have the contract that states the $3900 is for the Vision Correction Procedure, Operating Room & Laser Fees, & LASIK-Related Post-Operative Examinations & Enhancements within a 1 year!!

It is not my fault or problem that Dr. Shiller's licence was suspended 2 weeks after the surgery! He was the one who got arrested for his first DWI Feb. 2009 after he wrecked his vehicle & taken to the hospital where he tested positive for three illegal drugs including PCP, and was found to be in possession of Demoral that he prescribed to himself which in return the Texas Medical Board suspended his license for 9 months. ( He was ordered by the TMB to immediately quit practicing medicine which he could be in violation of for continuing to practice after the incident.

On August 27, 2010, the Board and Alan Dale Shiller, M.D., entered into an Agreed Order of Suspension, suspending Dr. Shillers license for nine months and thereafter until he requests in writing to have the suspension stayed or lifted and personally appears before the Board and provides convincing information that he is physically, mentally and otherwise competent to practice medicine. In addition, Dr. Shiller must undergo an independent medical examination by an approved forensic psychiatrist; participate in the Boards drug screening program; attend 90 Alcoholics Anonymous meetings in 90 days; and abstain from prohibited substances including alcohol in any form, dangerous drugs and controlled substances. The Order was based on Dr. Shillers inability to practice medicine with reasonable skill and safety to patients; failure to meet the standard of care; and dishonorable conduct that is likely to injure the public.

NACOGDOCHES COUNTY, TX (KTRE) - An East Texas doctor with a history of alcohol problems now has a felony charge on his record after pleading guilty to driving drunk with a child passenger.Alan Dale Shiller, 48, of Palestine, accepted a three-year probation sentence on the state-jail felony charge.Shiller was arrested in October 2010 after a DPS trooper said he was driving drunk with a six-year-old passenger in Nacogdoches County.Shiller, an ophthalmologist who practiced in Palestine and Waco, had his license suspended by the Texas medical board for another drunk driving incident that happened in December of 2009. The board said Shiller drove into a utility pole, left the scene, drove off the highway, through several mailboxes and then into a tree while he was on call.  In the December incident, he also tested positive for three other drugs including PCP, and he had Demerol in his pocket.

This business has no excuse for not providing a refund for services they didn't/couldn't provide. Pre-Op appt. on 1/26/10 & Lasik surgery on 2/5/10 at 5:45pm. I paid $500 on my Debit MC #6831 & the remaining balance $3398 on my Care Credit Account & have receipts for both & all paperwork from them. Patient Coordinator-M.Howard, Nurse/Technician-Jacklyn R. & Provider Christopher Rand. The first few of the follow up appts. they set up the day of the surgery but the rest of the appts. I had to call & set up myself even though they said they would contact me & mail me an appt. card but I never received anything. I kept going to my appts. waiting & waiting on my follow up surgery due to astigmatism & was informed by Dr Rand before the surgery was preformed that an enhancement would need to be done. Donna Ferguson informed me that was a false statement.

After several months(Nov.2010) after calling & calling trying to get a follow up enhancement they informed me that they didn't have anyone to preform the surgery but expected to in the next few months so I continued with appts. & repeatedly called them & they just said they don't have anyone to do surgery. Since this seemed odd to pay that much money & then never hear from them again I was suspicious & finally found out after calling to get status of a surgery date in 02/2011 that they closed down in Waco & should have returned my $3898 to me but didn't nor did they contact me about closing down until I called them. I spoke with Merle Brown several times & she stated that they still didn't have a Doc available. So I waited for a phone call & after several months again still waiting on a return phone call from a place of business that owed me services no follow up letting me know they still don't have a Doc or to even keep in contact like any place of business would do with their customers. They already took my money so they don't care about their customer service or keeping in contact with me per their actions & the way they treat their customers. I finally asked to speak to a manager after a few more months have gone by with no contact from them. I spoke with the so called manager Donna Ferguson which has no Management Skills or Experience around 7/2011 & asked why I still don't have an appt. yet & she said they don't have a doc still to do surgery.

She was asked why I was never contacted after the office in Waco closed down & she stated they sent me a letter in the mail & checked her file & the letter was returned. Although it was returned they failed to call me & inform me either although they were given updated address information they failed to change it or call me on the same phone # that I have. My guees is she just made up that story to cover their crappy service & lies. I asked why I wasn't refunded since they can't provide me with what I paid for in a signed contract & she said that just because that office closed they still had the office in Palestine & I wouldn't be entitled to a refund even though they can't provide the contracted services. I have all the original paperwork/contract, receipts, recorded phone calls, follow up vision test with a reliable optometrist that shows correct vision & that I am definitely a candidate for lasik & will be more than happy to provide this to ripoff report or anyone wishing to file a suit against this horrible company.  Donna Ferguson claims my vision was good enough & me not being able to see still was good enough service for Shiller Vision Center & can't give me a refund yet I can go to another Lasik center & they can offer me Lasik surgery to provide me with perfect vision without the use of glasses or contacts. All they provided is excuses & false claims!    

 I want & Refund & they owe it to me for not honoring a legal contract!! Plain & Simple!! I have the contracts to back me up so they have no excuse or lie they can say to make the contract go away. Donna Ferguson doesn't own or run this company & will file any false claim she can to try to get rid of myself or the complaint but that's not going to happen! She will even state that she never gets any email/phone contact from you just so she can be rid of you & scheme up any lies she can so she can file illegal false reports against anyone who try's to get in her way. Her role in this position is surrounded by lies & false reports & claims. The contract states they will provide an enhancement within a years time & they didn't/couldn't no other argument they can make will change the law or the contract! Dr Alan Dale Shiller & his business are still responsible for not honoring the contract no matter if his license was suspend or completely revoked. He took the money & didn't provide the requirements from his contract & that makes him legally responsible.

The contract didn't state the I pay $3898 & he will do half the work & then I go pay $3898 at another Lasik center for services that I already paid for to his office. I don't know if they don't understand the contract or what a legal contract means but they need to face the fact that they broke the contract & a full refund be provided to me so I can finally get the Vision that I paid for with a reliable establishment that isn't under the influence of drugs & alcohol. I have waited more than long enough for them to make this situation right but greed is more important to them than paying back for their wrong doing. They have drawn this game out long enough. They cannot win this battle with all the proof & facts against them. Stop the lies & pay what is owed to my family so we can be done with the childish games. Maybe they only mistreat/mislead military service members & their families. Dr. Shiller's office stands behind him 100% for his actions & multiple drug & DWI charges & even child endangerment. His staff should be checked into & wouldn't be surprised if he was providing the staff with prescription narcotics since he provides them to himself. I will continue going through every establishment I can to make sure Dr. Shiller & Donna Ferguson are know for their lies & unprofessional service. They need to be shut down & every one of them out of a job & have their part in this put out there for the public so they won't get screwed over like I did & others that are out there. I will not stop until I have my refund that I am owed. Just because the Texas Medical Board suspended his license for good he is still responsible for taking money for service he didn't provide. He should have thought about that before he went out drinking, drugging & driving.
