About 2 months ago we submitted evidence that Airpark Chrysler Jeep in Scottsdale, AZ had altered our credit application behind our backs and committed credit fraud.

Obviously this is O.K. as long as a company operates within the Banana Republic of Arizona. The only response we ever received from the AG's office was:

"We have reviewed your complaint but unfortunately are unable to take further action on it." --- obviously the company was not even asked to explain the alterations made by their financial manager before closing the case.

Time for a reality check, Armando - which planet do you come from ?

Obviously it does not matter to you if someone alters the information that you have signed, probably you would not even care if someone forged your signature.... According to your definition of fraud it would be OK for someone else to put your signature under a document as long as you don't receive any damages ?

Why you don't go to your favorite cardealer and give him a blank signature ? Tell him that you want to save your time and let him know that he probably knows best how to fill out the application or maybe he has some standard applications that are already filled out and you only have to sign that the information given is true and correct to the best of your knowledge...

Well, I have a problem with someone altering a document that I signed, especially if I signed under penalty of purgery that the information is true and correct to the best of my knowledge. Consumers like you who believe that there is nothing wrong with adding some fantasy stuff or changing the numbers are always welcome by businesses like Airpark Chrysler Jeep in Scottsdale-

Intent to defraud...

You wanted to buy a car. You applied for a car loan. You apparently got the car loan. You are claiming fraud because the lender approved your loan based on an altered loan app?

In order to prove "fraud" you have to show intent to defraud. How were you defrauded? How were you hurt? What damages did you incur as a result of the altered credit app?

You applied for a loan and you got it. Hard to show you are a victim here. If anyone should be making claims of fraud here, it should be the lender. The lender could argue it approved your loan believing the information on your loan app was accurate and truthful. Since the app contained false information, it could argue you are less creditworthy and more of a risk than they would have agreed to take on.

The lender is probably more the victim than you.

On the other hand, you'd probably have a better case to argue if you had actually been DENIED a car loan based on an altered credit app.

Problem is that many new car buyers do not have the back bone to go to Terry Goddard's office and COMPLAIN in a big way. Car buyers that are scammed need to speak up and make sure that Deceptive ways in the auto industry are exposed.

Even if there are no obvious damages it is still fraud - Altering credit applications behind the applicant's back is very common among car dealers

the altered credit application can be seen on our report about Airpark Chrysler Jeep- just pull up that report using Rippoff report.com's search engine.

The question regarding the damages-- ?

This is exactly the point: Altering credit applications behind the applicant's back is very common among car dealers: happy new car buyer won't complain and AG's won't take any actions ("Because there are no damages..." ???)

So it's de facto a legal thing in this state to alter credit applications, the lender knows this but if they would really pursue these issues they would loose a big chunk of business. Car dealerships do it because they want to sell as many cars as possible and if it becomes obvious that a buyer would not be approved they just alter their application the way that the lender would approve it. Part of their business.

Sure there are no damages- just profits: for the lender and the car dealer. And since this state is governed by the $$$$$ and it does not matter what is right or wrong, car dealerships don't have to worry that their criminal activities could have any consequences.

I lived in Arizona for maany years as well as many other places in the country. I also lived in Apache Junction/Maricopa-Pinal Counties.

I am really suprised as the State of AZ has some of the strongest consumer protection laws in the country. The Atty Gen is NOT the place to start.

Although you did not state exactly what was altered on your application, and what damages you actually sustained. However the Federal Trade Commission is a good place to file any violations regarding financing matters. Also, you ALWAYS have to start at the lowest form of enforcement and work your way up, getting documentation along the way.

Your local police dept in the jurisdiction of the business that you accused is a good place to start. File a complaint and get a copy of the report.

Also, these types of businesses in AZ are BONDED. Find out who bonds there license and file a claim for your damages.

The division of licensing is another place to file a complaint. Always either do them in person or mail them certified mail, return reciept requested.

How did they alter your credit application? What exactly did they change?

And more importantly, How were you hurt by this?

Perhaps the answers to these questions might explain why they declined to investigate further.
