MY BANK WAS COMMERCIAL FEDERAL RECENTLY CHANGED TO THE BANK OF THE WEST. WHEN THAT HAPPEND THEY SAID I CASHED A CHECK FOR $700 THAT WAS NSF. I NEVER DID AND BY TIME THEY FIGURED THAT OUT MY ACCOUTN WAS OVER $200 AND I HAD $75 IN NSF WITH OTHER COMPANIES.AFTER BANK OF THE WEST FIGURED OUT THAT IT WAS NOT MY CHECK AND FIXED MY ACCUNT THEY REFSUED TO PAY ME BACK ALL THE NSF I HAD SINCE I HAD CHECKS COMMING THROUGH MY ACCOUNT.

It's great that you got your funds back. I'm frequently accused of being a shill for the banks. Let this be a lesson that I'm really here for the consumer!

I DID WHAT YOU SAID AND I DID END UP GETTING ALL BUT $30 BACK. ILL TAKE WHAT I CAN GET AT THIS POINT. I KNOW THIS WASNT SOMETHING DONE IN PURPOSE BUT IT STILL AFFECTS YOU WHEN YOU ARE ON A LIMITED INCOME. THANK YOU FOR THE SUGESTION IT WORKED.

Let me reiterate just to make sure I'm clear on what's happening in your circumstance. You recieved a deposit correction notice stating that your account was being debited $700 because you had deposited a bad check. In truth, you had never made this deposit. You filed a claim (or initiated some type of investigation) which eventually cleared you of responsibility for the $700 as the bank apparantly debited the wrong account. In the interim there were OD fees on your account, which the bank is now refusing to credit back.
I would suggest contacting the bank and speaking with a supervisor, possibly in their claims department. Advise them that the fees occurred due to a bank error (the $700 debit that was not yours) and that you require that the fees be reversed. This is a regulatory issue, and you expect the fees back right away. If they won't budge, get an address for their office of the chairman and write a letter explaining the situation. Send a copy of that letter to your state's banking department, and the Office of Comptroller of Currency.
Plain and simple, the bank is wrong here. I doubt that they're intending to rip you off, but the agent you spoke with may not understand the situation. I would escalate it and give the bank one more chance to make it right, and then go above that if you still haven't received satisfaction.
