I worked for them for a short time. I closed two loans while I was there. After I left them they refused to pay me my commissions. My branch manager told them to pay me and the owners, Tim and Tracy Baise refused to pay me. I went through arbitration, received an award for $7200. They still refuse to pay. I'm forced to seek out payment through collection methods. These people have no integrity. I highly recommend you stay away from this company.

I have done business with Tim Baise. I knew him to be a gentleman, a Christian, and honourable in every aspect of our, and, I can only imagine, all of his dealings.
The accusations posted by "Ben", above, defy belief. Further, they contain much of the language common to any malcontent who has suffered from some oversight or malfeasance of his own creation but cannot accept the fact that he is the author of his own misfortune.
I can assure anyone who may come across this sad effort to smear the reputation of a good and honest man that any such actions as are suggested are totally out of character for Mr. Baise. As such, they are unbelievable and should be disregarded.

Wow, this scheme looks exactly like the one by Pacific Bancorp with the infamous Santoli's, Tom Mitchell and Jacob Beechler. Very similar branch and pay structure, same unethical and unprofessional complaints. Same and oh so suspicious different company names and licenses in each state, and they opened up about the same time Pacific Bancorp was forced to close by the regulators odd coincidence.

An arbitration award can easily be confirmed as a court judgment, which
can then be used to collect payment from the losing party.
The Uniform Act contains provisions concerning: (1) the validity of
arbitration agreements; (2) procedures to compel or stay arbitration;
(3) the appointment of arbitrators; (4) certain procedural rules
regarding the arbitration hearing; (5) calling witnesses and engaging in
discovery; and (6) the format and timing of arbitration awards.
Sections 11 through 18 of the Uniform Act discuss jurisdiction, venue,
and enforcement of the arbitration, which in a nutshell there is still room to negotiate this arbitration down to a 360 degree turn. And, you say in your own words you were forced to seek payment thru collection methods than change the story to Tim wrote a check for the full amount. I guess I am confused?
This is an exploitation of the 1st amendment and
the "Wild, Wild West" nature of the laws governing freedom
of speech on the internet. Accordingly, true or not, one complaint on Rip-Off
Report can severely damage - even ruin - an honest
company.

Cynthia,
I was ready to put this to bed but I guess someone always has to stir the pot. I can assure you that your claims speak to absolutely nothing regarding the above post. Did you not understand that I have an arbitration award from an arbitrator that reviewed my case and determined that Tim was illegally withholding my commissions. He ordered Tim to pay me. Tim had 30 days after the award was issued to pay me. With blatant diregard for the law, he still failed to pay. In Michigan Circuit Court, a judge will treat an arbitrators award as if it were an order of the court and will enforce it in the same manner. I filed suit in the Ingham County Circuit Court suing Top Flite & Tim case #09-00009-GCD to begin collection of my money. The day the Sheriff served Tim his papers he cut my reimbursement check for legal fees and ordered payroll for the commissions. He realized he was not going to get away with stealing from me.
This is not about scrambling to put gas in my car as your situation may be different from mine. I paid almost $2k in up front legal fees to pursue this matter. It's about doing the right thing and conducting yourself in business in a reputable fashion. Tim, throughout all of my experience with him, has done exactly opposite of what a reputable person would do. I spoke out because others need to know about his actions. I also noticed now that someone else has spoken out on ripoffreport.com with a similar complaint. Have you ever heard the saying "Where there is smoke there is fire"?

If no fraud was committed than you will receive your commission case in point!

To the public,
I am Cynthia Russell and I was a branch manager with Top Flite Financial for 2 years. I shut down my branch because of the volatility of the market. I had deposited $5,000 in a reserve account to handle any said incidentals in the event of separation.
I contacted the owner (Timothy Baise) and I received nothing but sheer honesty and the truth in which was all my money would be returned to my person once reconciliation was done on my branch account to make sure I had no bills outstanding.
The situation mentioned above with a former employee was one of a compliance issue so you are looking at a longer period of time to reconcile the situation. The point is if no Fraud was committed than you will receive your commission case in point. What would Top Flite have to gain by keeping your commission? I don't think any business wants to lose their reputation because that you can not put a price on.
I know with the economy today and everybody scrambling to make a dollar to put gas in your car, make your mortgage payment and etc. It is easy to point blame when you don't know where your next meal is coming from but I have to go back to the old analogy which is don't assume anything as it makes an a*s out of you and me (assume) and the old concept which is patience is a virtue.
I can say without a shadow of a doubt that Top Flite Financial will remain in business during these tough times because of their compliance procedures. Sure we all want to get our commission as mortgage brokers and really don't care about compliance but we need to be empathetic and put ourselves in the owner's shoes as with the regulation coming down on our field we have to cross every T and dot every I and come April 1, 2009 than every broker will be responsible for keeping their own good name if they choose to conduct business in this field.

Ben Dehaan,
That's funny, the only thing I ever received was a letter stating the arbitration was suspended and not going further, if something changed I am sure I would have been notified.
Additionally you are to cease and desist from any and all false and defamatory remarks made about Top Flite Financial, Inc and/or any of its employees whether those comments are made verbally, via written documents and or web related content. If I see one more false and/or slanderous remarks made, you will be personally sued to the fullest extent of the law.
Besides keep in mind the truth always prevails! You were terminated for cause prior to any commission being earned per your written and documented employment agreement. You were the one in the wrong, violated TFF company policies and procedures by giving a borrower a VOE to get completed on their own thus resulting in fraud being committed on your loan. Worse off, not even taking two seconds to verify the accuracy of the information contained in the completed VOE that you personally received back to see that the landlords contact information was in fact the borrowers cell phone number prior to sending to underwriting thus jeopardizing our long standing relationship with this particular lender. Any mortgage professional (with less time in the business then you) knows that a VOE can not be given to a borrower to complete!
If anyone that is wrongfully subjected to reading this blog wishes to do further due diligence on me or my company I welcome it with open arms.
