MY PAYMENT IS DUE ON THE FIRST OF EVERY MONTH. HOWEVER, I HAVE UNTIL THE 10TH OVER EVERY MONTH TO PAY THE BILL WITHOUT INCURRING A LATE FEE. FOR THE LAST NINE MONTHS I HAVE PAID THE BILL BEFORE THE 10TH DAY. RECENTLY I HAD BEEN LAID OFF AND I AM 42 LATE ON MY PAYMENT. I NOW AM EMPLOYED AGAIN AND HAVE THE MONEY TO MAKE ONE PAYMENT THIS WEEK AND THE NEXT PAYMENT AGAIN NEXT WEEK WHICH WOULD BRING MY ACCOUNT CURRENT.

SO I SPOKE TO ONE OF THE REPS AT TRIAD AND LET THEM KNOW THAT I WANTED TO MAKE A PAYMENT OVER THE PHONE AND MAKE THE FOLLOWING NEXT WEEK. TO MY SURPRISE THE REP TOLD ME THAT IF I COULDN'T MAKE BOTH PAYMENTS NOW THAT HE WOULDN'T TAKE MY MONEY. HE ALSO STATED THAT FOR THE LAST NINE MONTHS I HAVE BEEN IN COLLECTIONS WITH THEM AND THAT I HAVE BEEN A PAYMENT BEHIND FOR THE LAST NINE MONTHS AND THAT IF I DON'T MAKE THE PAYMENT FOR BOTH MONTHS THAT THEY WILL TAKE MY CAR FROM ME. I THEN CHECKED MY CREDIT REPORT TO SEE IF THEY HAD BEEN REPORTING ME INCORRECTLY AND THEY HAD MANY 60 AND 90 DAY LATES ON MY REPORT WHICH IS NOT TRUE.

I BELIEVE THAT THIS COMPANY IS RUDE, THEY HARRASE YOU INSTEAD OF WORKING WITH YOU AND THEY ARE ALSO GUILTY OF VIOLATING THE FAIR CREDIT REPORTING ACT.

Mari, Just to let you know, there is a lawsuit in the making right now. Read my latest post, it explains why I know this. I just posted it today 05/23/05. It's quite funny that since I emailed Sergio the legal dept supervisor and told him about the phone calls I received(explained in today's post) he is now asking for "victims" to call him. Yeah right. I did that also and got screwed. That's OK though, I have enough against this company that bythe time all victims come forward or are located, the Federal Gov't will fine them so much they won't have enough money left to cover payrole!!!

It will take time, but it will happen. There are so many victims it is taking some time to locate everyone. We are working very hard at finding everyone. I can't go into too much detail because the slimeballs read this forum, but ease your mind as best you can knowing justice is in the works. Good day to you.

Class Action Law Suit

I had the same problems with Triad. My distant family members were contacted stating that they had a warrant for my address because they didn't have my new address. They continously harrassed my family and kids when ever I was late on a payment, and said the would send me to jail for not paying on my car. If anyone knows of an attorney or of a class action law suit that I can join please let me know.

Jennifer from San Antonio, Let's get the ball rolling with a class action. I've been contacting class action attorneys, and just waiting for responses. Are you still in? How about every other Triad victim? The time is now to get these lying pieces of s**+*. Together we can nail their balls to the walls!!!! How about it people? What is everyone waiting for? Please just respond to my recent posting dated 4/2/05. All I need from any of you, is "I'm in" Ripoff Report will notify if they have anything of interest to report to a possible attorney willing to take them on. I know and you other victims know that they would loose hands down. So with everyone willing to stick together, we can make this company pay. Hell, if they are a division of Ford, let's add them to the class action. So,...........Any takers?

Ok here I go; once your car was reposed and sold you are left with a balance. To be truthful lose contact with them wait about 6 month then call them if you have a $6000.00 balance offer them $2000 to settle the account (make sure that you get a letter them from triad before you give them any money) your best bet is to call them on the last week of the month and please make sure that you have money on hand.

To beat the beast you most understand the animal within.

Do not lose your cool at any point during your conversation with any collector. If they ruffle your feather or too rude ask for a supervisor. Make sure you make a log of phone number that you call, time that you call and the people you talk to, they will come in handy later. Only the green horn collector think it's funny to piss off a debtor no matter how you look at it you are a debtor. The season collector will work with you.

Isn't there anyone who knows how to put a stop to TRIAD

i wrote earlier that our car been repo'd and we were unable to do anything about it and not informed, that our car had already been sold, even though we wanted to pay.

now we received a letter, stating that after the car was sold we now still owe them 6000,-$
As usual, we are still not receiving any bills, nor do we have an address where to mail the money order. My husband says, he is not going to pay them...and I know there is more trouble on the way....

the things they do to their customers can not possibly be legal.....

Triad Purposely Tries to Hurt Consumers' Credit Rating -- They Must Be Stopped!

My husband and I have had similar issues with Triad. I was unemployed back in SC in 2002 and had made 2 payments with promises of more as my unemployment checks began to come. The customer service reps (?) -- I beg to differ they were customer service -- more like customer abuse reps informed me and my husband that we were "losers" and was just trying to get away with something slick. We were harrassed with phone calls 3-4 times a day back in SC. To make a very long story short -- our car too was repo'd in the middle of the night with no notification that they took the car -- no demand payment letter -- nothing. They did not give us a chance to make right on this loan -- which we had the total for the loan in a cashier's check waiting to pay it as soon as someone told us where to properly mail it. No one ever called us back once they realized we had the money. I believe this is a scam ring to get people's cars back in order to re-sell at their exhorbitant (illegal in some states) interest rate. I wish someone would take these guys to the Attorney General's office in the state they live to do something once and for all. My husband and I are now enjoying a bad credit score along with many, many other issues -- thanks to unemployment which I had no control over and an arrogant credit financial company that has no business doing business in any state.

TRIAD CAN'T GET OUT OF THIS...

I HAVE HAD ALL THE PROBLEMS LISTED ABOVE AND HAVE SPOKEN TO THE SAME INDIVIDUALS AND RECIEVED THE SAME TREATMENT AS EVERYONE ELSE. THIS TIME HOWEVER THE STORY TAKES A TURN IN A DIRECTION THAT TRIAD ISN'T USED TO... THEY HAVE VIOLATED BOTH FEDERAL AND STATE STATUTES AND COULD VERY WELL BE ON THEIR WAY TO INVESTIGATION BY MANY GOVERNMENT AGENCIES.

THEY FINANCED A VEHICLE IN JAN 2002 THAT HAD A LEIN ON IT THROUGH A SEPERATE FINANCE COMPANY AND THE TITLE WAS NEVER TRANSFERRED TO THEM- NOR WAS MY NAME LISTED AS REGISTERED OWNER. THAT IS JUST THE BEGINNING... I HAVE PROOF THAT THEY KNOWINGLY FAILED TO DISCLOSE THIS INFORMATION AND JAVIER ADMITTED THEY WERE GUILTY OF BREACH OF CONTRACT AND OFFERED ON TWO SEPERATE OCCASIONS TO PUT ME IN A VEHICLE 3 TIMES THE VALUE OF THE ONE IN QUESTION. I DECLINED AND STATED I WANTED FULL RETURN OF ALL MONIES PAID AND HE GOT IRATE WITH ME. THAT WAS NEARLY A MONTH AGO AND THE COLLECTION CALLS PERSIST, LETTERS DEMANDING FULL PAYMENT ARRIVE IN THE MAIL AND FALSE THREATS OF REPOSESSION ARE MADE. THEY CAN'T TAKE THIS CAR AND THEY KNOW IT... IT NEVER BELONGED TO THEM AND THEY HAVE NO INTEREST IN IT WHATSOEVER! SO THIS TIME THE JOKE IS ON TRIAD... WHO IS A FORD MOTOR COMPANY AFFILIATE. CAN YOU SEE DIANE SAWYER TELLING AMERICA THE STORY ON DATELINE'S CONSUMER ALERT?

I AM ON THE VERGE OF FILING A LAWSUIT AGAINST THEM WHICH I KNOW I WILL WIN. IF THEY DON'T SETTLE AND THIS GETS TO COURT IT WILL EASILY BECOME A CLASS ACTION SUIT. CONTACT ME FOR MORE INFO.

Could not do anything about it, My husband is in the military and we just got back to the states from germany.

My husband is in the military and we just got back to the states from germany. we financed our car through TRIAD and in the first 3 months we did not receive any mail (no bill) from them.
My husband called them several times to ask about the status of his account, but everytime they just said the paperwork hasn't been processed yet. We had no information on where to make a payment to and sure enough our car was reposessed. my husband called them again and was told, when we pay the outstanding amount of
2000-something $ we would get the car back. so we saved up that money and gave them a date, when we would come to indianapolis to pay the amount and pick up our car.

Today (2 days before we were going to see them)
my husband wanted to verify our appointment and was they told him, the car had been sold.
I AM SOOOOOOOOO UPSET !!!!!!

And still we haven't received a letter from them...and they do have our address!
we have no paperwork from the reposession either.
Is this even legal? no note, that our car is up for sale? no note, when the car is going to be/ was sold?

The thing that upsets me the most, even with frequent phonecalls, we were never given sufficient information on the situation and thus could not do anything about it.

Just had to get this off my chest.

I HAD THE WORST NIGHTMARE TO BE FINNANCED BY THEM. THEY HARRASE YOU, THEY MISINFORM, AND THEY DO ANYTHING THEY COULD TO MAKE U FELL THE WORST. YOU ARE NOT A CUSTOMER, YOU ARE A DEBTOR NO MATTER WHAT.

EVEN IF YOU ARE ON TIME ON EACH OF YOUR PAYMENTS.

I AM ABLE TO JOIN MY SELF ON A CLASS ACTION LAW SUIT AGAINST THEM. COUNT ON ME.

ASK FOR A PAYMENT HISTORY FROM THE CUSTOMER SERVICES DEPT THEY SHOULD GIVE THAT TO YOU, IF AT ONE TIME YOU WERE LATE AND NEVER CAUGHT UP, THAT'S IS WHY YOU HAVE ALL THOSE LATES ON YOUR CREDIT, BUT IF YOU HAVE PROOF THAT YOU WERE NEVER LATE(CHECKS FOR EVERY MONTH) THEN JUST SUE THEM. THAT IS THE WOUNDERFUL THING ABOUT THIS COUNRTY. IF YOU HAVE ANY OTHER PROBLEMS POST YOUR QUESTIONS BELOW.

On January 20th, 2004 Triad Financial Corporation made an erroneous debit of $400.93 from my account. Due to this my account is now negative $322.52.

Previously, ever since October 2003 that is, due to a change in employers, I have been a month behind in my payments to Triad. This is due to the fact that my paydays are different. I have informed them of this verbally and in writing. I have told them that I am trying to get back on track but it will take a while, that they are NOT the only BILL that I have.

If I am a day late on my payments the calls start. I get a call the 9th of the month, they say I am late; contractually I am not, until the 10th. I tell them I have sent a check, give them the check number, and then they tell me it could take up to 3 weeks for it to process (?).

Then the next day, and the day after that, and the day after, EVERYDAY the call. I no longer answer the phone UNLESS I know who it is.

The constant harassment, that this company and its employees know no bounds. It reached a new low last week:

On the 16th of January, I spoke with Sammy Hudson a Triad Customer Service employee, and stated that I needed to change the date of my Check by Phone debit from the 17th to the 30th. This was due to the fact the check I was expecting was not coming until the 30th of January. He stated that was fine and I thanked him.

I just returned home from work at approx 745 AM on January 21st, after staring in horror at my on-line bank statement, I called Triad Financial Corporation around 800 AM and spoke to the Triad Customer Service employee that originally changed the date; Sammy Hudson. I informed him of the error in turn, I was told to Fax a copy of my bank statement to provide proof of the $400.93 debit and any NSF/Overdraft charges. The fax was to be: Attention: Kenebra Wilcott the Triad Customer Service supervisor who handles these errors.

After trying to attempt to fax the documents NUMEROUS times I realized that I was given an incorrect fax number by Mr. Hudson and after several attempts to contact him to get a valid fax number all I was able to reach was an answering machine. I thought I was being given the run around due to their bad rating at the BBB.

After not being able to get into contact with Mr. Hudson I spent approximately 4 to 5 FRANTIC hours speaking with numerous customer service representatives trying to find a fax number that would get this incident resolved by getting the documents into the hands of Mrs. Kenebra Wilcott,

Finally, at approximately 100 PM, I reached Mr. Hudson. He stated he was in meetings all morning. I asked him to check if the documents that I had faxed have been received. I also told him that I had to use another fax number because the one that he gave me was not working. He stated, after putting me on hold for a few moments, that he has not received any documents from me. He then realized that the fax number that he gave me had 1 incorrect digit, he apologized for the inconvenience.

Mr. Hudson then gives me Mrs. Kenebra Wilcott extension and to call her in an hour because they were going to lunch.

I then sent another fax.

I spoke with Kenebra Wilcott at approx 200 PM. I was calling to confirm that she had received the faxed documents, she stated that she had not, due to that mornings meeting she did not have the time. She stated that she will need to investigate the incident before a decision is made to credit the $400.93, plus any NSF/Overdraft charges, to my account, at the time the NFS/Overdraft charge was 30.00.

On Thursday, January 22, 2004, I spoke with Kenebra Informing her that I would be faxing an updated bank statement with NEW NFS/Overdraft fees that they will need to pay. And that I need this credited to my bank account no later that Friday the 23rd. She stated that they do not redeposit, that the check would be mailed. I told her that this is unacceptable.

I sent a fax with a cover letter stating that if my account is not credited by Friday, the 23rd on January, my power will be disconnected. That I live in a mobile home and my stove and furnace are electric. With no electricity I will not have a way to cook food for my two children and that I will have no heat when the temperature has been a constant 20 to 30 degrees at night and 40 to 50 degrees during the day.

And if the sum of $550.93 is not credited to my account by Friday I will have no other choice but to take legal action against you for the return all monies erroneously debited from my account and an additional cost for the inconvenience that I and my family have suffered due to your mistake.

She acted like she did not care my children would go cold and hungry.

My electricity will not be cut off due to the fact that Progress Energy was nice enough to extend my payment to the 30th.
I do not have money for Food for my children, for them to get school lunches for the following week.

Make triple copies of your Proof Of Payment records

They do not have the right to report inaccurate information. If you have proof of on time payments, make copies to send to them and the appropriate authorities, or even a lawyer, if necessary.

What was your payment method? If it was through your credit card, they have all information archived and can mail you the requested copies. If it was through your bank, it would show in your standard bank statements. Check with your bank customer service in person. Tell them you want to dispute the charges, and inaccurate credit reporting. They might be able to provide with even better information.

If you paid through money orders, I pray you have save all money order copies.

The key would be in:

1. Your payment due date
2. The allowed mailing time "Grace period",
3. and your consistent payment date in all records.

You have to be sure to account for potential mailing delays.

You have the right to dispute unfair credit reporting. Don't let them get away with it.

Access www.ftc.gov They have a separate section for this you can research, and more information on The Fair Credit Reporting Act. Review and print out the information, to keep with your documentation.

TRIAD Reports FALSE INFORMATION!

Triad reports FALSE information about your payment history to the credit reporting agencies so their customers can NEVER refinance to get a better rate! I have been a (hostage) customer with Triad for over 2 years and have NEVER been 30 days late but they report that I am late on my payments to them.

Let's get a class action lawsuit started against TRIAD. I'm willing, and I have PROOF of my timely payments to them.
