I entered the Million Dollar Makeover contest and was contacted by Federal Express on June 22,2005 saying I was a potential winner and had to complete the affidavit and have it notarized and return it within 3 days and I would be contacted shortly after with more information. Every contest or sweepstakes says you are a "potential" winner until you return the affidavit because they need to make sure you meet all the requirements before awarding the prize but I have never been sent an affidavit and then been denied the prize for any reason).

Later on that day, I got a call from an employee named Scott Myers congratulating me on my win. I have saved the answering machine recording and it says, "Congratulations on being one of the 64 contestant winners and winning the trip down the Florida." He also said he needed one more piece of paper signed from me so let him know how he could contact me. I called him back and left a message on his voice mail with my fax # and he faxed me the papers I needed to sign (these papers verified how much weight I had lost etc.) On the cover sheet of the fax it says "Congratulations on being selected to come down to Florida!

I waited and finally when it was one week before the trip(2 days ago, on July 11th), I called the company to find out when more info. would be coming and the guy said I was not one of the winners. He said that I was an alternate and all alternates recieved the Fed. Ex letter and he has no idea why Scott from Trim Spa called me and told me I was a winner but Scott was no longer with the company. He kept saying that he didn't know why this happened and even admited that his company had made a mistake.

Yesterday (July 12th) my husband called the company to complain about what happened and see if I could be compensated in some way, another guy finally called him back and basically said they MIGHT be able to put together a goody bag for me with a t shirt in it for the error. Before my husband hung up, he said that a lawyer would be contacting them and the guy from Trim Spa said that he should be sure and tell the lawyer that Trim Spa had contacted me to tell me I was not a winner after all.

When my husband questioned him about this, he said that they had mailed out a postcard to everyone who entered who was not a winner letting them know this. My husband and I do remember getting a generic card saying "Sorry you were not choosen" but this was right after we had gotten the Fed. Ex letter and call and assumed that we were just on the mailing list because I had also recieved a postcard from them after I had sent in my final "after" pictures and essay reminding me to "get my entry in quickly" even though they had already recieved my entry.

I feel like if I was not truly a winner, they would have not sent me the first letter or would have called or sent another Fed Ex letter letting me know that I was not a winner after all. The first guy at Trim Spa that I spoke to was pretty much speechless and could not explain what happenend and it was only after my husband spoke to someone after leaving several messages that they came up with this story about notifying me so I think this was just their way of geeting around it.

The trip was supposed to have been for 6 days 5 nights to the Hard Rock Hotel and Casino for 2 including airfare, some meals, spa treatments etc. plus 2,500 spending money(value of $5,200). This was what the Contestant Winners were to recieve but there were other prizes as well. They are giving away Dodge Vipers and $100,000 to the two over all winners who will be selected in Florida next week. My daugher had ben my "coach" during the contest period and I told her if I won any money, I would take her to The Mall of America with the prize money. After I got the phone call and Fed. Ex. notice, I booked the trip that I now can not afford.

This is not to mention the fact that we had to rearrange schedules to get off for the trip, get someone to watch my daughter while we were in Florida etc. not to mention the humiliation I am feeling because I told everyone I had won the contest and now I have to tell them that it was a "mistake".

Trim Spa was not very nice to me or my husband and we don't know if we have any legal re course so I thought I would start with this web site.
