My father-in-law was contacted today by this agency 'UCB', by a miss named Susanne Walker, to locate me and my wife. She was rude to him, and left her number, stating that this was regarding a Citicard/Citibank bill, and that she had to be called back within an hour.

Indeed, the Citibank bill is overdue, but what can you expect when you are out of a job for 2 years. Upon calling the creditor I calmly explained (over and over again) what the situation has been, and that I am employed since the new year - allowing me to pay regular bills for everything. She didn't want to hear any of it, and told me that if I don't pay immediately, me and my family will be sent to prison.

She told me to take a loan with family, sell my car, or whatever - or I'd go to jail. Too bad she didn't include 'rob a bank or something'.
She was not willing to give me an e-mail address to reach her, and didn't want to give any further information about her company, which is what brought me here.

How to Respond to These Collection Vultures

Greetings. These people are vultures, nothing short of that. As an attorney, while I cannot represent anybody through this site, I can offer you guidance as to what you may want to do.

As you may or may not know, these people are governed by the Fair Debt Collection Practices Act (FDCPA). You can find this law and the regulations surrounding it at the this web address: www.ftc.gov/bcp/edu/pubs/consumer/credit/cre27.pdf
Also be aware that you some states have tougher laws than this, so check out your state equivalent of the Federal Trade Commission (FTC).


It is a simple law and easy to read, but here are some highlights.

Number one, if one of these "agencies" calls you, they are required to follow up in writing within five (5) days with any demand. Then, upon your receipt of their letter, you have 30 days to seek validation of the debt. When you do so, make clear that you are not seeking confirmation of your address, but that you are seeking their validation that you, in fact, owe the debt. They must provide the proof within 30 days. Proceed then. In addition, in your validation letter, you may demand that all future correspondence be in writing (this must be in writing).

Here are a couple of other pieces of information:

They are not allowed, by law, to threaten to sue you, unless they actually intend on doing so. Typically, "intent to sue" means suing within 5 days of the threat. Idle threats to sue are ILLEGAL.

They are not allowed to threaten criminal sanctions, for instance, jail. This is ILLEGAL.

If you are represented by an attorney, tell them. Once they know you are and contact you, this is ILLEGAL.

They are not allowed to call any other person and tell them about this debt...other than to find or verify your contact information. They cannot discuss the debt with ANYONE BUT YOU.

If you tell them that you are not allowed to receive such calls at work, they are prohibited, by law, from calling you at work (this does not have to be in writing).

Finally, any abusive, threatening language is illegal. KNOW YOUR RIGHTS. DO NOT LET THESE PEOPLE INTIMIDATE YOU. LET THEM KNOW YOU KNOW THE LAW.
