They keep calling me about my daughter who does not live with me and is responsible for her own life.
I have asked them to stop calling - but they do not. I am worried.

This report is about your firm repeatedly calling someone who has no business relationship with you, or debt, and your firm continues to HARASS them with telephone calls. You knotheads are violating the FDCPA as you know.
""My statement is this, dont be afraid of us, we are not your typical 1980s collections agency that all we want is your money.""
NO ONE should be afraid of any outfit that violates the FDCPA and can be successfully SUED in district court for actual damages, reasonable attorney fees and statutory damages up to $1000.
""We all have felt the economic hit and we are all suffering from it ( trust me) Please understand that we have a job to do. When we call you to talk to you ,we NEED TO TALK TO YOU.""
Hey pal! Did you read this report? The author has asked your firm to quitcalling. The FDCPA clearly states that numbskulls such as you can call for the purpose of acquiring location information for the debtor-ONE TIME. What part of ONE TIME don't you and your brilliant cohorts don't understand? You better brush up on Section 804 of the FDCPA.
Oh, I know you're going to mention the exeption-if you folks think the information is incomplete or has changed, but let me assure YOU that that excuse won't hold water to a judge or a jury. I have testified in court on behalf of debtors against debt collectors and the debt collectors LOST-repeated calls to a relative or neighbor of the debtor will be interpreted as deliberate harassment and a ruling of FDCPA violation will be made, with the appropriate damages awarded to the person harassed. I suggest you brush of on Section 806 as well (Harassment or abuse.)

Remember you may not be the only person with your name floating around there in this world.""
You folks need to brush up your skip tracing methods. There are other methods besides verifying the SSN over the phone to ensure you are contacting the CORRECT person-the debtor. These more precise methods cost more to perform so many debt collection agencies don't use them.
""We are hear to help you get your bill paid whether you are unemployed or disabled we want to help.""
RUBBISH. You are hired to collect for the creditor-period.

What the author of this report needs to do is send you clowns a certified, return receipt requested letter, that clearly states that the debtor does not live with her and that she demands that your harassment STOP IMMEDIATELY. What this letter will do is set the state for a lawsuit against your company and criminal prosecution if you clowns are fool enough to call her again after your firm has received her letter.
""You nor the debtor will go to jail it is not a crime to not pay your bill its just a simple pain in the neck, dont be angry that we called you just own up and deal with it, we will work with you. That is what we are here for.""
Even if we DID have a "debtors prison" who could someone who DOESN'T OWE the debt going to end up in jail? LOL! It's is not a crime to not pay a debt, and it certainly is not a crime to not pay someone else's debt. LOL! Your posting is laughable.

West Asset Management is a reputable company, they are Country wide and have many contracts with many different companies, they do Medical, student loans, taxes etc.
My statement is this, dont be afraid of us, we are not your typical 1980s collections agency that all we want is your money. We all have felt the economic hit and we are all suffering from it ( trust me) Please understand that we have a job to do. When we call you to talk to you ,we NEED TO TALK TO YOU. For those who have family members in their homes that feel your personal financial information is their buisness please understand that BY FEDERAL LAW we cannot and will not talk with them and that means your spouses. Alot of states have seperate laws that must me followed first and foremost. So when we ask to speak to Jane Doe and John Doe wants to know what the call is about and we dont have verbal permission to speak to you dont get nasty with us just put Jane on the phone we will get permission and then talk to the both of you. When we call and we need to verify your Address and SSN its not because we are nosy or trying to steal your identification its only to make sure we dont share your personal financial information with a stranger. Remember you may not be the only person with your name floating around there in this world. Now I will give you a collectors secret, it is that if you dont feel comfortable verifying your information that way, we are able to verify by your middle initial if one is provided by our client. We are hear to help you get your bill paid whether you are unemployed or disabled we want to help :secret: if you are disabled you may be able to get out of paying your bill by providing documentation from a doctor or the SSA. (100% only) :MYTH: Not all collectors make commission

Another thing is that those who get calls on a regular basis and it has already been confirmed that it is a wrong number. YES I would say get the fax number or "Coorespondence Address" to send a letter that simply states your phone number that is being called and a request that you dont want anymore calls. If you know the person we are calling and confirmed that the information is correct you may give us the contact information to call them to resolve the issue you may also request that we do not tell them where we get this information from.
ALSO THERE IS NO DEBTORS JAIL. You nor the debtor will go to jail it is not a crime to not pay your bill its just a simple pain in the neck, dont be angry that we called you just own up and deal with it, we will work with you. That is what we are here for. I hope this helped
