Category: Auto Dealer Repairs Submitted: 9/6/01
Modified: 9/15/01

I purchased an automobile, 1990 Jaguar from Westchester Auto on February 10. 2001. At the time of purchase repairs were to be made on the car and were under warranty. These repairs are:

1. Noise from rear end: Differential/Power Lock was to be replaced or adjusted
2. No or Poor acceleration/Stalling/Engine turning off while driving: Fuel Pump/Crank Sensor
3. Front and Rear Rotors worn
4. Front Driver Seat Belt to be replaced
5. Gas Tank Sender Unit to be replaced.

The auto was not repaired at time of purchase. I returned it one week later for repairs. The repairs were not made. I returned the auto in April for the 3rd time.

In addition to the repairs, the alarm system was shorting out and it effected the battery and I was unable to start the car. I purchased a new battery. The problem with poor acceleration/stalling became progressively worse. At this time I had requested that the outstanding repairs be made. Again, I was told that they had been completed.

I returned the car again for the fourth time in June and three weeks later I was called to pick up my car and that all the repairs were made. Again, the repairs were not made. I called Westchester Auto to speak with the manager and I was verbally attacked.

I then brought the car to a Jaguar dealer to access the problems and I was given a report and an estimated bill of $7,162.63. I then called Westchester Auto and spoke to the owner and arranged a meeting on August 6, 2001 to discuss the repairs. I met and reviewed the report and he agreed to make the repairs at no cost to me and I found that to be fair. Three weeks later I was told that the repairs were completed and the car could be picked up at any time. The repairs were not completed.

For each time that I have brought this auto in for repairs it remained on their premises for two to four weeks at a time. Since February, I have put less than 3,000 miles on the car. I have also had a witness for each meeting with Westchester Auto. Furthermore, they never provided me with a loaner car or compensated me for any inconvenience.

I recently sent a certified, return receipt letter and have not gotten a response. I spoke with a lawyer and it is confirmed that I have valid civil lawsuit.

I would appreciate any advise that you can offer. The automobile industry (especially the used car market) it notorious for ripping people off.

Sincerely,
Lisa Dowe
