Trying to get mortgage loan. Lender saw on credit report that Cross Country bank had filed a chapter 7 on this credit card. No chapter 7 has been filed by me in the last 11 years since my first marriage in 1991. I call cross country and they tell me that a lawyer had notified them (cross country) that we filed a chapter 7.

Where is my copy of the report and where in any paperwork says that that could happen. I dug out every notice sent to me. They still insist I owe $474.70. I could swear I paid them off two years ago. How could they do this?

If I want a copy of the lawyers report I must write a letter saying that I had no knowledge of this situation and request that it be taken off. Then they must call the lawyer and ask this person to do so. What a bunch of crock.

I need help this is unfair and illegal as hell.

If you had filed Chapter 7, it would have been shown under the Public Records portion of your credit report, including date filed, case number, court, etc. Additionally, IF you had filed another Chapter 7 since the first one, you wouldn't owe Cross Country anything, as it would have wiped out that debt.

Sounds to me like they are trying to blackmail you into paying them $400+. You need to FIRMLY INSIST they provide you with the "lawyer" who "notified" them that you had filed Chapter 7. What a crock! The "laywer" would not have done that, they would have received noticed from the US Bankruptcy Court, so insist that they provide this doumentation or immediately correct it.
