 I suffer seizure attacks, and permentitly damaged shoulders. I had a doctor fax them a letter that I could not workork. I do not drive, so it is not walking distance. The people are rude that work there, they do not have a pool, steam room or sauna, so basically I have no reason to workout there. I do not have a fax machine, which their manager Steve said "He would be so kindly to let me use" (Lol 53 cents is so much to spend) They had Addous and Associates call me to tell me they are trying to collect on debt. It was a voice mail so I thought it was many of many of doctor bills. I did a google search, just to see it was IRSHA (A puppet orgination for health clubs)

I knew right then and there it was crunch fitness. I was so angry that 1 year ago they said they were canceling it. I called them and gave them a mouth full (words I can't use on here) The lawyer who was a redneck from Utah, made it sound like well if you pay the $88 it won't go on your credit. The $88 is not the point, it is fact that I ask them to quit this a year ago, and they agreed. I explained that I do not drive so I can not go to the location. The guy laughed on phone and said it is your attitude (I have worked out for close to 20 years and I know it could be any reason just to get money from a human being.)

I called the lawyers office and told him he is harassing me. He tried to say, we only called once. So you are the only harassing us. I told him him in explict language that if he never contacted me in the first place I would have never contacted him. What seem to send a scare down his spin was the fact that I told him, I was taking the Gym to small claims court for whatever money it cost me to clean up my credit, and I was subpoena him in from in Utah. He suddenly speech, and said what do I have to do with this. I said, well you are a materially witness.

For $88 this Crunch Fitness was willing to fight this crap. I guess they don't think I am serious about going through crap (unlegal terms). I am going to sue both Crunch Fitness and Addous and Associates for $7,500 each. They draw up a big contact stating all these terms that you need a lawyer to review, and refuse to let you quit. I didn't ask for to have Seizure Attacks, nor did I want a buldge in my back or or a permentant dent in my shoulder. I don't understand why they can't mail me the quit form for 53 cents.

They said I can mail it certified, well that me getting a ride to the post office which is 4 miles away. They just want to make this hard as possible for a case they are probably going to lose. Are gyms that desperate for money that they have to pull this crap? Let's say I have a seizure attack in the gym, or pull a shoulder or back muscle, isn't the gym liable for not letting me quite? I was so pissed when that coward attorney called me to make good on a debt I never even owed? It cost $350/ hour for an attorney and I am going to make Crunch Fitness pay ever cent of it.  WHY CAN'T THESE PIECES OF SH*T GYMS LET IT GO.

Memberships at Crunch are month-to-month contracts, and a member can cancel at anytime and for any reason by coming to the club to sign a cancellation form or mailing us a letter expressing the intent to cancel.  The membership also allows a member to freeze their membership for up to 6 months at no charge for medical reasons. 

On June 18 2012 Crunch received a medical note from the members doctor along with a request to freeze the membership, which Crunch approved.  The membership was frozen for the months of June through November 2012, and then became active in December 2012.  Membership dues were billed and paid by the member from December 2012 through February 2013, but then in March 2013 the dues became delinquent, and 60 days later the account was turned over for collections.

On May 7 2013 the member called the club and told them he had cancelled this membership.  The club staff informed the member that there was no record of him cancelling.  The member stated he would resend the cancellation request, but to date we have never received anything.

Instead of sending us a cancellation request the member has called the club staff and been very rude and foul with our staff and our manager. 

As a good faith gesture Crunch has cancelled this membership without receiving any signed request from the member, and we have asked the collections company to cease all collections efforts.  We have also tried to contact the member to inform him of this decision, and to ask the member to please not contact the club staff again.

I am sure you can have 2 law suits for $7,500 each on small claim court in the same year. I assume that you are doing this in CA. You may need to check the rules.

Speaking of sending the cancellation confirmation (letter) to them, they may counter your claim about going to the post office by saying that you could let someone else do it for you without your physical present at a post office (common sense). So you may win the cases, but I am not sure you will get as much award as you think. Just to let you know what you may expect for the outcome.
