I am presently seeking legal representation for a warranty / finance / identity dispute with DriveTime. This is just a sample of the first issue. I just bought my car in 10/2010 and less than 2 days off the lot I had problems. I took it to the dealership to return it because we have a cancellation period here in Colorado and they insisted I would be charged money to return the vehicle and that if I kept the car they would make sure the problem was fixed. Well needless to say but after 6 mo's, 4 different shops, countless down time w/o a vehicle, the car is still not fixed. I personally had it looked at by a special mechanic to diagnose the problem, after he diagnoses the issue DriveTime says they won't fix it because it was from the previous ownership, even though its the same issue since I bought the car!! By the way the car is still in the shop!!!

I was wondering how did it go as far your situation is concerned, if has not been resolved please join me. I trying to start an class action lawsuit against this company I'm currently in contact with the attorney general, and trying to find an lawyer to help the lawsuit.

As a former GM of DriveTime I warn as many people as possible about this
company and it's practices. I would like to have a dime for every time
I called the service center
and spoke to the manager there about brakes that were so rusted, or
rotors that were badly pitted. One of my customers actually had her
brakes catch on fire! Interestingly enough, each one of these vehicles
listed a very expensive and complete brake work done with all components
checked and brand new rotors. I saw cars
that were charged with 3 new batteries at the service center that I had
to put a new battery in at my dealership. Many vehicles had parts and
repairs charged to them that never actually took place. I was told by
my district manager to keep my mouth shut!! Drivetime stopped letting
lot porters, who might have at least has a small sense of auto
mechanics, check in the vehicles at the lots and started making the
salespeople do it!!! Sales people are not mechanics. This is how they
got the individual dealerships to take the blame for repairs. Then they
would not allow us to take care of the customer. As GMs we were all
very upset because now tranny
and brake issues, etc. would not be found until their "check in" period
was over and the dealership
would be stuck with the bill. Most dealerships didn't want to pay for
this because it would potentially take away from our manager's bonuses.
Just google the history of Ray Fidell and Ernie Garcia. See what
interesting projects they were involved in in the past. It will make
you go wow!! They traded one scam for another!!

In all probability the bottom line here is this person was/is late and/or was repo'ed. If you read these reports you will see the vast, vast majority of complaints about s/p lenders is just a smoke screen. The real issue being they are late and think the lender should look the other way.

The title of your complaint states that DriveTime sold your information and lied about your income .
1. DriveTime carries it's own loans. Why would they gain by selling your information to anyone? You signed the privacy policy in your vehicle contract.
2. DriveTime makes you prove your income through paystubs or bank statements. Once again, DriveTime carries their own loans. Why would they lie about your income to THEIR OWN COMPANY? The company makes money when the customer pays for the vehicle. It's not a dealership that sells your loan to another bank unless you default completely on your loan and have your car repo'd. It would be interesting to see how you try to back up your statement that they lied about your income. If you want to say it's because the salesperson needed a commission - all salespeople at DriveTime are on salary.
3. There is NO cancellation period (aka right of rescission) in Colorado. This information is provided directly from http://www.co.jefferson.co.us/da/da_T99_R24.htm
"Rescission rights are also known as cooling-off periods or cancellation periods. Colorado law allows specific transactions to be rescinded. Please note: Vehicle purchases do not come with a rescission or cancellation policy."
