Beware to all you iso's and agents, this company acts like they are on your side and says your residuals are for the life of the processing of the merchants, when in reality they have a clause in their contract that says if you do less than 2 accounts per mo minimum they will cut off your residuals, this happened to me. After i called in to try to figure out why my residuals were not paid when Mark who no longer works their said my residuals are for life. Chanda was the first who was extremely rude to me, followed by Rosa and then Bobbete.
Shortly their after they would not allow me to try to adress the matter with any one able to repair the situation. I then recieved a phone call from Lane, who is the owners son, he then proceeds to belittle me and tell me how rich he is and how I am nothing to him and pretty much just trying to say I am a stupid (((REDACTED LANGUAGE))) and how he f'd my mother. This is wrong and childish from any company and the reason why I am writing this is so that if this rip off report was up when I was looking at getting into business with them I would have been able to be more cautious or have an attorney look at the contract and have it ammended in my favor.

EPS has not given me any of the money they owe me, and every mo are making money off of the accounts they tricked me into signing up with them thinking I would be getting paid, but instead they are just like all the rest of the cons just lying and taking advantage of the honest person.

Apparently, you are confused with what you agreed to in the contract, perhaps you should read it over again. I am looking at your contract as I write this, and the Schedule A Attachment which details the residual income and vested interest terms has NO cross outs and NO approvals to anything different than what I previously posted; it is clearly signed and dated by yourself.
The section which you crossed out was Section 17. Competitive Actions which states the agent would not represent the competition while representing EPS, which is reasonable and standard business practice for many companies. You have written on the contract "This is a non-exclusive agreement," which by the way, simply writing something on a legal document without both parties initials and notarized does not legally change the terms of the contract.
EPS has gone above and beyond and has made every effort to be fair with your situation, first by not holding to you to the exclusive, non-compete conditions of your contract, next by giving you several notices and opportunities to get back on track so that you wouldn't lose residuals, and continuing to pay residuals well after the time you breached the terms. You ignored all our calls, ignored our countless attempts to reach you, and finally contacted us back several months after residuals ended. You are now trying to extort the company into paying you by filing complaints that are simply not true; it's blatantly obvious who the dishonorable and money hungry party is.

Its is very nice to see their policy, however in my situation I was told as well as crossed out and signed, and then approved with the fact that I didn't have to have any minimums to get paid, however EPS would not honor this agreement they had with me via Lane Dorsey. All I want is to be paid on my residuals on the accounts that I brought to them as agreed which they will not honor because they are money hungry and not honorable.

EPS has been in the processing industry for over 20 years with over 500 independant agents/ISO's nationwide, all of which agree to and sign the company's standard agreements. EPS conducts business with the highest level of integrity and actually goes out of its way to rectify any issues with both its agents and merchants. It is clearly stated in the agent/ISO contract that an agent must be vested for lifetime residuals. Following is the excerpt from the SCHEDULE A ATTACHMENT TO MARKETING AGREEMENT:
RESIDUAL INCOME
"Provided Contractor adheres to all provisions, sections, paragraphs, covenants and material content contained in the Agreement for TWENTY-FOUR (24) months from the date of this agreement including but not limited to; the Marketing Agreement, this Schedule A and the Guidelines attached and made a part of this Agreement, and submits TWO (2) new merchant applications each month that are approved in the normal course of business for 24 consecutive Months, After that period (24 Months) Contractor will be fully vested in the residual stream they have built."
EPS greatly cares about its agents, goes above and beyond to support them, and gives many notices if they are slipping behind to ensure they don't lose their residuals. Our standard policy before any residuals are ceased are as follows:
1) EPS Sales Support calls all agents on a weekly basis to discuss their specific situations and provide any support they may need.
2) EPS contacts agents who have not submitted a deal within 30 days to discuss lack of production and inform them of their residuals status.
3) EPS examines each situation thoroughly to determine if any special circumstances warrant the continuation of residuals once a breach of contract occurs; there are many instances where EPS has continued residuals even though an agent was not vested to assist them while they get back on their feet.
In addition, this specific agent did not return our numerous calls or contact EPS for almost 8 months after residuals ceased. This complaint is an attempt to disparage the company from an agent who not only did not follow through on his contractual obligations but also blatanly ignored his responsibility to rectify the situation in a timely and reasonable manner.
