I was contacted by LP&A about a month ago and was fooled into sending them payment via moneygram. I did not make a full payment of the ammount they requested. I only payed $200.00.

They told me they were contacting me on behalf of cashnminuites.com and that felony charges were pending if I did not pay. After the initial payment and one other small payment of $126.00 I disovered this web site. I tried to contact cashnminuites to find out the original ammount of the loan and how much was due on the account and was refered to call LP&A. Then a LP&A "investigator" called me and siad I was legaly not allowed to contact cashnminuites.com .

When I talked to him he said the original loan was for $150.00, but that I owed more for legal fees. He said that I could settle for $855.00 and the case would be dissmissed. I am aware that felony cases cannot be dismissed once the are filed easily, because the state can decide to prossecute anyway for the crime. It was possible that they filed a civil case, but I didn't think so or i would have recieved a summons.

So I tried to call his bluff and asked what the doccet number was for the case. He couldn't give me that information. So, I asked for a detailed bill of the fees and fines I owed. He also could not provide me with one.

He said I had made two payments already and that I owed one more payment of $295.00. Going of of the settlement ammount he just gave me I would actually owe $529.00. He wasn't even aware of the ammount I had payed.

What I want to know is if having payed $336.00 on a $150.00 loan would i have satisfied the obligation to cashnminuites.com, or will i still have to deal with LP&A. I should note the last payment was due a week ago and they have not made contact with me about missing the payment.

Don't pay another cent

Don't pay one more CENT. The laws in your state (Indiana) are very consumer friendly in this case, and this collector as well as the original company are already in violation of them. From the Indianajustice website:

Regarding payday loans:

A payday lender cannot use, or threaten to use, the criminal process to collect the payday loan debt. The payday lender also CANNOT:

Make false or misleading statements about payday loans;
Contract for and collect attorney fees on payday loans;
Change any information on the check that the lender is holding; or
Charge more fees or higher interest than allowed.

The lender can be fined up to $1000.00 for violation of the Indiana Payday lending law. Indiana Legal Services can assist you with this. I recommend you contact them immediately.

Don't speak to this collector any more, or give them money. It would be a very wise thing to close your checking account and open a new one at another bank as they have your bank info from your original check.

When they call you, hang up the phone. Don't be intimidated or allow them to make you think you are subject to any laws in this matter other than those in your home state.

sir i do not condone any illegal collection acts, but might i suggest that before obtaining a loan from a paday advance company you read and fully understand the terms and conditons of the loan because i got a loan from cashnminutes.com.

about a year ago i read the terms and conditons and the contract stated that my account was set up for 66. bi-weekly and that this did not pay down my balance. i didn't understand this but continued to pay it. i got really tired of it and revoked authorization from my bank. i then got a call from LPA. they faxed over a copy of my original contract with this highlighted "ANY revoked authorizations closed/frozen accounts will automatically accure attorney court cost collection fees as well as the maximum course of action allowed by law to collect the debt."

now i read this and thought so what. so i took it to my attorney who read me payday loan laws and you would not believe that some states have no legislation on lending which means they can charge whatever they want as long you agree to this. so if you get the loan you agree automatically, my lawyer stated that i am stuck. i could either pay it outside of court or retain him and pay it in court. i chose the latter of the two. so in closing you should definently read what you are getting before you start getting yes happy. matt

I was contacted by Chet Stevens again yesterday, demanding $295.00 or he would fax in the court documents and preceadings would begin, to the best of my knowlage, and I might be wrong, you can't fax in a afidavid for the courts. He asked me why i didn't make the last payment. I told him that there was a problem- that he was misrepresenting himself as an employee in a legal office and he is not. He assured me that he was from a law firm and then did more threatening to me until he heard me say noncommitently-Ok to everything he said. Never once told him I would just said OK alot.

Anyway since he wanted to press the law firm issue I contacted the Texas Bar Assosiation and asked them if Sam shapiro or the company Legal Processing Associates were licensed to pratice law in the state of Texas.

They replied to me today they do have a Sam Shapiro listed, but he is a law student in San Antonio with the St. Mary's Civil Justice Clinic. They could find no information for the company or the person specified as the Attourney with this office. They informed me that if they are engaging in an unauthorized pratice of law to file a complaint online at txupc.org. I urge anyone contacted by this company to not only file with the attourney general of Texas but to also file a complaint on this site.
