Over three years ago, an aquaintance of mine called and told me that he was representing Nextel in Fort Walton Beach, Florida. He told me that he was being paid $100 for new sign-ups and was I interested. I had contemplated a Nextel and agreed to ONE phone listed in the Atlanta area.

On his next trip to Atlanta he presents me with two phones, both of which had been activated with Florida phone numbers. He told me there would be no cost for cancellation if I did not want them. I told him that I had agreed to one phone and I would transfer it to Atlanta under my work but the other one was not authorized. I called and cancelled one phone and transferred service of the other to the Atlanta area.

I could not get service on the phone anywhere in my area but I kept it through my year's contract period and cancelled it. At this time, a year later, I received a phone call that I owed Nextel about $600! I explained that I had upheld my contract. They then said that they new NOTHING about that but that I had cancelled TWO contracts and I owed them. I told them that I had never gotten a bill from Nextel and they proceeded to give me an address in Ft. Walton Beach, FL where my mail was going.

I explained to them that I was a single mom with small children so I would have no use for two phones. I also told them that I had NEVER lived in Florida and could prove it since I had been working for the City I live in for five years. They would not listen and were VERY rude to me and accused me of lying. I explained the whole situation and told him that the acquaintance was now in jail for fraud and I needed help to get this right. I gave them all my current information and was directed to the fraud department. I have never heard back from this department.

I was contacted another time. The lady was very nice and knew that I was telling the truth. She transferred me to account services where they agreed with me on the situation and tried to help. They told me my nightmare was over and I have the confirmation number.

NOW, a YEAR later I have received my credit report and there is a collection listed on it for $300! I have just remarried and we are trying to build a house. I had worked on my credit for years following my divorce and this has pulled down my score by nearly 100 points! I am assuming that this is for the second phone that noone could ever locate in their system! It is now jeopardizing my entire family.

PLEASE HELP ME!!! If this has happened to anyone else I need to know!

Here some other things you could try:

1) Go to you local police station. Tell them that you want to file a police report that someone has pulled identity theft on you and the company involved is Nextel. Show them copies of your bill(s) to use with the report. Tell them that you tried to straighten this out with Nextel and it's been to no avail. Also let them know that you were able to find out that someone else's name is also on your account. This will at least put a hold on everything.

2) Look in your government listing under US, find the FTC, there should be a 800# listed. You may be on hold for 5 or 10 minutes, but please wait for someone to get on the phone. They will take a report of what is going on. Let them know you want to file a identy theft report and a report on Nextel for illegaly allowing this to have happened. They will file such and give you the numbers to which they were filed. Then you ask them to advise you as to what to do next.

3) Then fax, mail, e-mail whatever you need to do, and send Nextel a letter telling them that you have excercised your right and file the above with the FTC. You would like this straightened out before going any farther. Give them the repoert numbers, if you filed with the police department, they will also supply you with a report number. Tell Nextel that you had no choice and the law allows them no more than 30 days in which to correct this and you want a letter stating that they in fact have corrected this.

Companies will get away with all that they possibly can. But if you stand up and let them know you know your consumer rights they usually become more workable.

I am still desperate! ..refused to provide me with who the authorized agent that signed my contract was

Thank you so much for your help! I have sent two faxes to the mediation dept. at Nextel. I have called and both Customer Service agents knew it was wrong but could not help me.

One even refused to provide me with who the authorized agent that signed my contract was and would not tell me who the dealer in Ft. Walton was. She said that it was not legible on the contract! I certainly don't want her to put her job on the line but goodness! Wouldn't you think if they had accepted a contract they would know from who!!

Also, the agent asked me if I knew some woman. I thought she was making small talk about the town I was from and I thought a minute and apologized by said that I didn't know her. Come to find out that apparently this women's name is on my account!!

It is a mess and Nextel is stalling me!

Sorry to hear about this.

Here are some things you should do:

1)Send a "Certified, Return Receipt Requested" letter to Nextel. Tell them you are required by law to allow them 30 days from receipt to correct this. After 30 days, if you have no response or are not happy with the response, you then send a copy of this letter, a copy of the signed returned receipt and a letter to all 3 Credit Reporting Bureaus. The CRB's have but 30 days to inquire with said company have this corrected. Nextel will place this on on reports.

2) Also send the CRB's a identity theft letetr requesting that any contact to them be presented to you first.

3) You can also send a letter of explaination to the CRB's to ntoify anyone looking into your report as to why this was placed there.

Go to the FTC's website at www.ftc.gov, they can give you more information on what do.
