My husband was sent a letter by Risk Management Alternatives from Duluth GA. We were told that he owes Sears X amount of money, now my husband did have a Sears account once with his ex-wife once but hasn't since. His brothers have also used his name and SSN to obtain credit before and then not paid and it gets put on his credit report.

I wrote RMA a letter and asked for proof that my husband owes this money on this account. I asked for receipts, a copy of the orginial agreement, anything that had his signature on it, and proof that they are registered with the state of Kentucky to collet debt. I sent it register mail so I would have proof that I contacted them. Under the Fair Reporting Act they have up to 30 days to respond. They did not respond except to call my husband on his cell phone at work, I don't know how they got the number, but tried to trick him into saying he owed the debt. He asked it they had gotten our letter, they said yes, and he told them to follow the letter. Not once in any of my letters did we refuse to pay, but just want comformation that he owed the debt. After 30 days I again wrote to this company, and again asked for comformation of the debt, I gave them 15 days to reply, and sent it registered mail, again I recieved no answer, so I wrote a last letter and gave them 7 days to respond, I sent that one registered mail also. I now have a paper trail, and they are in violation of the Fair Reporting Act since they still have not responded.

I will now take the letters I have, make copies of them along with the receipts to show that they were recieved and mail them to Fair Trade Commission, and the State Attorney office in Georgia and file complaints again RMA. Then I will mail all this along with my letter to the Credit Reporting companys and ask them to delete this from my husbands credit report. By law they have to investigate, and if RMA cannot comfirm, which they can't or they would have sent the paperwork, then the credit companys have to take it off my husbands credit report. I hope this helps someone else who has had a problem with this company.

You are on the right track with the FTC. You may want to consider sending a letter (Certified Mail Return Receipt Requested) with a cease and desist request. Under the Fair Debt Collection Practices Act, "debt collector" may not contact you after receiving written notice to cease communications. Many debt collectors attempt to hide under the ambiguous exception that allows them to confirm residency of the alleged debtor or if they believe you are providing false information to them. If in fact they are looking for you or someone who resides at the residence they are calling, your best bet is to place them on notice with a cease and desist. They still can contact you for the purpose to informing you of any escalated actions they WILL take. They cannot threaten to take actions that they have no intention of taking, however that has wiggle room as well. I noticed on one of the other posts they listed the originating phone number with a 281 area code. The address listed under it was in GA. The 281 area code is in Texas, specifically in the Houston area. If the calls are originating from this number you may also have a complaint or cause of action under Texas state law. Texas laws concerning debt collection practices are very protective of the consumer. There are even criminal statutes that could be applicable. If in fact the calls do originate from the 281 area code, I would also file a complaint with the Texas Attorney General's Office. The FTC receives numerous complaints regarding violations of the FDCPA and your complaint may be filed as just one more. Good Luck..

This company supported Whitewing Financial. This is the same company that the FTC shut down. I can see that the apple does not fall far from the tree.
