Good Afternoon. I pulled my credit report to find a listing from this company on my record. My report states that I owe ATT $52.00 for a bill, with a first delinquency of 8/2003, assigned for collection in 7/2005. Ok, this is great, except.....I've never had an ATT account, and have had the same phone company/number for over 13 years!!!! In the comments section it states 'Consumer disputes this account information, Customer has now located consumer'. What the heck does this mean????

While we're at it, there were several other entries on my report from companies that I've never done business with. I disputed these charges a year ago (ok, call me dumb for not checking to make sure it was taken care of), but they insist that they never received the dispute because 'the address listed on the credit report is incorrect'. In addition, several other accounts have been taken care of because they weren't mine (now tell me, would you take a credit app with a phone number starting with 555???? This is getting old folks!). How do I get these people AWAY from me???? I'm obviously not doing something right, and need to be steered in the right direction.

First off (if you haven't already done so), get yourself enrolled in your pick of credit monitoring services that monitor all 3 credit reports (that way you can see changes immediately online).

Next, pull all 3 credit reports. Then send certified return receipt letters to each account holder that you disagree with. Make sure to start each letter with "Upon pulling my tri-merge credit report on XXXX, I notice your account. Be aware that I am disputing this debt in its entirety and request validation. It is inconvenient to contact me by telephone. Sincerely..." Remember to mail these certified, with a return receipt.

Next, a week later, send letters of dispute to all 3 credit bureaus disputing the inaccuracies. Make sure you are as specific as possible with your disputes. Again, mail CMRRR.

Wait for the fallout (or fallOFF). Your credit report disputes will either work or they won't, in which case you should probably repeat the process one more time to make sure the offenders can't claim their actions were a mistake.

The collectors will do one of three things: 1) ignore you completely and post/re-validate a negative account on your credit report, 2) ignore you completely - they don't appear on your credit reports - and you never hear from them again, 3) they attempt to send you bogus documentation to try and prove the debt is valid and then post/re-verify a negative account on your credit report.

If #1 happens, send another letter stating that you are still awaiting validation and repeat your demand for immediate deletion of the account from your credit reports. They'll probably ignore you again, but at this point you can prove willful noncompliance of the TDCPA and the FCRA. Take all of your paperwork to an attorney who specializes in debt collection law...can be found on the NACA website.

If #2 happens you can rest for awhile. Keep all of your correspondence and receipts and keep monitoring your credit reports to see if they ever pop up. If they appear on your reports or send another collection letter to you prior to sending validation, then you can take the attorney route that I described above.

If #3 happens, immediately send them another letter rejecting their bogus documentation. Tell them that the account is still disputed and to remove their tradeline from your credit reports. Sue if they don't respond to your demands.

Read up on the FDCPA, the FCRA and most importantly for you, Michigan's Debt Collection Laws. There are protections and remedies that are specific to all three and combined can pack a punch that a collector won't soon forget.
