I purchased a Lawn mower from a company called

Garden Way
I think it was 1995. The lawn mower was returned. Initially Garden Way/ Troy Built didn't have the return paperwork that the lawnmower was returned and tried to bill me for it. After sending Garden Way the proof from FedEx that the lawn mower was returned it was resolved, I thought...

 

A year or 2 later I receive a letter from Cradle Company. Now they were trying to collect for the returned lawnmower.  Anyhow I sent them the information. I am glad I kept it, and I called Garden way to find out how this could happen so this could be finally be resolved and this would not happen again. They said they never authorized Cadle to collect this. They apologized and said it was an error. Apology was accepted and I though this was resolved.

Today, 14 or 15 years later I get a call at or from the Cadle Company. They are telling trying to collect for this same lawnmower that they weren't even authorized to collect for. They a man named John Glucknert and a woman named Clair Insisted that I pay for this lawnmower that I returned to

. I attempted to tell them what happened and that this was resolved with Garden way and that this is a mistake. They insisted that I pay or else!!!  

 

This is crazy!! Who are these people? I am scared and don't know what to do. This guy almost gave me a heart attack this mornig. My wife wanted me to go to the ER. I am still not ok. I am very angry and upset. I feel like they are trying to extort money from me holding my credit rating as hostage!!!!

 

Can  someone please help me??

First of all, you may want to check with several state government agencies in your state to see if they are legally licensed/authorized/etc to do business in your state.  In most states, collection agencies are regulated by that state's Department Of Insurance and must be licensed with the state through either the Department of Insurance, etc.  I would start and check with that agency first of all.  Your state's attorney general can also tell you which state agency regulates collection agencies if the DOI does not do that in your state.  You might also want to check with the Secretary of State to see if they are a licensed corporation as well.  If they aren't licensed to do business in your state, and in fact they are doing business, I would file a complaint with the appropriate state agency.  The state will take it from there!


In our state, collection agencies must be licensed with our state's department of Insurance.   I will check and do the same.

You owe NOTHING, after 14 or 15 years later  (Your words) this is FAR PAST Any Statute of limitations, they're hoping you don't know this, and are hoping you're gullable.

Write them back and tell them you know this is beyond the statute of Limitations and Ignore any threats, they can't do anything but threaten and Lie.

They are scamming you.

And they Cannot threaten or post ANYTHING on your credit report without being arrested  themselves or lying about the dates. If they do YOU can arrest THEM (They know this).
