 I am bringing my complaint here too raise awareness about whats going on at Vida Vacation. I made the mistake of believing what my sales rep told me. I told them we had 2 week with Shell Vacations that we rarely used. They told me of a plan that many of their memebers use – it was we could sell our Shell through a broker they recommended and get money for those. Then whatever weeks we didn’t use from Vida could be rented out through the same broker. A year and a half later nothing has happened i feel like fool because I believed them, I couldn’t imagine how the developer Sr. Daniel Chavez would allow his sales people to do such things. But after reviewing the internet, sadly I’m not alone- I have just seen the Youtube video “The Philanthropist and his Mayan Empire”- I’m originally from Guadalajara and its sad for me as a Mexican to see how a man capable of such greatness has allowed this. 

  I didn't dream up the rental income aspect, it was pounded on by Vida reps and managers for 6 hrs.

So Vida allows its guests to be "trick f^%#ed and set up for a fall" by its sales reps and Vida accepts zero responsibility for their fraudulent conduct. You all must be very proud of yourselves.

Sadly, your situation is something very common, it happened to me 2 years
ago, i've spent a lot of money and i was scammed by other companies.
I recommend you that if you're going to hire a company to help you with
the problem, DO NOT PAY ANYTHING UPFRONT, because it use to be a fraud.
I was investigating a lot on internet and i found some interesting articles,

Appeal To Mr. Ivan Chavez (Owner)

Mr. Ivan Chavez,

I have posted here sevaral times before, and will continue to post until Vida Vacation/ Vidanta cancels and refunds my fraudulently obtained contract.

I am once again reaching out to Mr. Ivan Chavez the owner to intervene and do the right thing. I am a recently widowed Senior Citizen, I have tried to use this as it was sold to me but none of what sales said would happen has come to pass.

Briefly, they were to supposed to have one of the resale brokers on a list they gave me sell my Shell Vacations timeshare...they said it would only take 90 days max....almost 2 years later I still have it and continue to pay maint. fees.  The very same broker was going to rent out our Mayan Palace weeks for $1,000/wk net....never happened....in fact the broker is out of business,  all their phone lines are disconnected.

Is sticking it to Senior Citizens something Vidanta wishes to be known for Mr. Chavez? We all know what happened to me, it's not unlike what has happened to countless others. I will not stop posting and spreading the word about your sales teams tactics. Maybe $21,800 is nothing to you but it's a big deal to me.


No rental income, and I'm still paying maint fee's on the two Shell weeks.


It's just not fair Mr. Chavez, I really don't know how you can just stand by and do nothing, it's very sad indeed.

Vida Vacations Vidantas Ruthless Cirques Of Deception!!

This is absolutely shameful that Vidanta refuses to recognize my legitimate complaint and forces me to make public my grievance. If I was the party that was being untruthful then they would have a legitimate complaint that what we are doing is extortion. I stand by my story.

These are excerpts from previous posts with Karen Rose Vidanta's PR person:

"as stated in your contract, remember the company makes no representations regarding the market for vacation ownership rentals or resale, nor recommends buying this product for rentals, resale or investment".

"we look forward to helping you both within the legal boundaries of your memberships with us and we remain at their service".

My response:

Ms. Rose, I don't dispute that your contract covers what you state. What I am disputing is how the contract was achieved, something that I've stated in each of my posting but something you refuse or can't address without admitting culpability.

Fraud: If one person knowingly made a material misrepresentation that the other person reasonably relied upon, and disadvantaged the other person. A material misrepresentation is an important untruth. The contract may be set aside on the grounds of fraud. Fraud requires an outright lie, or substantial failure to state a material fact about an important part of the contract. Fraud will invalidate a contract. Thus we contend the contract you mention is invalid.

You refer to legal boundaries, does Vida consider pitching rent and resale to prospective members within legal boundaries knowing it’s a benefit that will NEVER be achieved? If I understand you correctly you're saying that Vida sales reps can misrepresent your product to unsuspecting clients tell them whatever is needed to achieve the sale, and Vida policy is that this practice is within legal bounds and Vida will support this duplicitous way of selling. Due to the facts I’ve presented this is the only conclusion one can draw. It’s worth mentioning, this contract has never been used. Although the contract says it’s not to be purchased for investment, the sales team made repeated assurances that rental income and the resale of the Shell property was not going to be a problem.

Yes, I am guilty of believing the Vida sales team. And Vida’s position Ms. Rose, is that was a mistake on my part? This entire contract was achieved via lies and deception. Please address why you allow such deceptive sales practices and then blame the unsuspecting consumer for believing what they were told by sales reps representing Vida Vacations.

Vida Vacations Conspires To Defraud

I posted here about a month ago.

Short story: Bought a timeshare in Nuevo Vallarta last year. They promised to have a previously owned Shell Vacations timeshare sold in addition they sold us a rental package. Well neither happened.

Longer Story: My recently deceased husband would always handle this kind of stuff, so I was kind of lost on what to do. I told a friend about how I was stuck with this Vida timeshare and they recommended a third party who had a lot of experience in this field. I contacted him and he agreed to help me.

He put in a request to cancel it after I told him how I was lied to. Vida didn't like that and said they would only cancel/refund my contract after:

I told the person I would work with him. Vida didn't want to work with a third party, even though it is my right . So I canceled my agreement with him. They still refused to refund.

Then they said send us a copy of his contract. So I did. Then a Vida lawyer calls me to ask me some stupid questions. Still no refund.

Then they ask how we found this person. I told them I heard about him through a friend who used him. And this person didn't want their name used because their settlement included confidentiality. If Vida knew they spoke they could go after them for the settlement. Karen Rose who has been the voice of Vida during this told me unless I gave the name I would not receive a refund. So Karen told me twice I would get a refund and never delivered. Kind of a theme at Vida.

Vidanta sales conspired with brokers to deceive me and countless others. Ms. Rose constantly refers to Vida's legitimacy so how do they consider deception and out right fraud to be legitimate?

They are shameless!!

Vida Vacations Still Lying!!

 They say they are looking forward to have my as a hppy member. If I bought it to use that would be wonderful. However I believed the Vida sales rep and I bought for rental income and they were supposed to sell my Shell Vacations weeks....neither has happened. Make those to things happen and I'll shut up and be happy. If you don't refund my money I will never stop posting the truth of what happened to me. You can threaten all you want (which they have) with defamation but as long as I'm telling the factual truth I can say whatever I please. It's called freedom of speech.

Vida doesn’t dispute that I was lied to, and in fact this would be an unrealistic position as their notorious practices are well documented throughout the internet.  What the company does say is that those promises made by the sales team are not consistent with the timeshare contract, and therefore Vida will not support the representations made by its sales teams.  If the members choose to dispute their contract they must travel to Guadalajara, Mexico, hire a local attorney who speaks Spanish and file a case with an arbitration board.  This would likely take eight months to two years of hearings to conclude, some of which would require the plaintiff’s attendance. Obviously this makes the likelihood for such a dispute, as well as its proper resolution all but impossible.

We are not, nor have we ever disputed that the agreements signed do not meet legal standards under Mexican law. What we contending is the manner in which said agreement was achieved. Vida Vacations Sales Rep’s are trained by Vida Management to sell the Vida product using deceitful and duplicitous tactics.

Vida Avoids The Truth

What the company does say is that those promises made by the sales team are not consistent with the timeshare contract, and therefore Vida will not support the representations made by its sales teams.

 

If the I choose to dispute my contract I must travel to Guadalajara, Mexico, hire a local attorney who speaks Spanish and file a case with an arbitration board. This would likely take eight months to two years of hearings to conclude, some of which would require the my attendance. Obviously this makes the likelihood for such a dispute, as well as its proper resolution all but impossible.
