So a friend of mine, her daughter, and our friend all go out to Wal-Mart on our way home. We wanted to show OUR FRIEND that we appreciated him for tutoring HER DAUGHTER, and took him out on a day. We were there for a few hours as everyone is, and when we're in the electronics department FRIEND OF MINE opens a phone package to look at it. None of us appreciate this and take no part in it, eccept for FRIEND OF MINE.

When we go to check out, I'm short a few bucks and decide to hit the ATM, it won't work. So I decide to purchase what I can and hit the bank ATM out maybe 2-300ft from the store and come back for the rest.

We get to the door and we are all stopped by the securi-cops. FRIEND OF MINE has some answering to do for the phone. "Property Damage" the man says. So I tell FRIEND OF MINE not to worry after long amount of arguing and crying from FRIEND OF MINE and HER DAUGHTER.

Get to bank ATM in hopes of being able to recieve amount for phone so I can hopefully keep HER DAUGHTER's mom out of jail. No one should grow up without a caring mother. ATM will not allow ANY withdrawl. D**n.

Get back to Wal-Mart in hopes of returning everything to purchase phone to keep FRIEND OF MINE out of jail. Waiting outside the security room the man approches from somewhere else and drags me in with him. He said FRIEND OF MINE had shoplifted and that I helped her. I did not. He also tries to pin it on HER DAUGHTER and OUR FRIEND.

We talked him out of those two but FRIEND OF MINE and MYSELF are being held for the same thing, when I did and knew nothing. How can I get out of this alive. I have no job and what I do for shelter and a living is taking care of FRIEND OF MINE and HER DAUGHTER AND SON.

            PLEASE HELP!!!!!!!! Someone....

I bet there are a few details left out

Also, you said:> We were there for a few hours as everyone is,

No, I don't think everyone hangs out for hours at a time at Walmart.

Even if WalMart lets you off the hook without filing a police complaint they will likely try suing each of you in small-claims court for damages. You need to get your name cleared first. WalMart has video of the incident. It will either clear you or incriminate you. You would have had to have been shielding her actions from view in order to be considered an accomplice.

If the police get involved they will review the video and determine if either of you committed anything illegal.

Good luck either way.

Blowing this out of proportion

Have the police come and charged you with anything? If they havent, then you have nothing to worry about except being banned from that walmart. If the police have charged you with shoplifting, its just a misdemeanor charge. Go to court and plead not guilty and ask for a pre-trial conference. At the pre-trial conference explain the situation with the prosecuting attorney and go from there. Go to trial if you have to. Even if they make you pay, its only a small fine.

it does sound like your friend does need to own up to walmart. Opening electronics in the store is a no-no, walmart cant sell that item now. Your friend did damage property and you shuold probably reevaluate the type of friends you have.
