On 6/3/06 my husband and had a credit report pulled were in the and on the credit report was two accounts one thru AAC and the other for Asset Acceptance, both the same accounts in the amount of 879, which was for an old credit card my husband with Direct Merchants Bank back in 2000. Which had a high balance of 605 and according to a report from equifax it is showing that the account was paid and there is a $0 balance,date of last acitivity was 12/00

So on 6/12/I had called AAC&had spoken with a Denise Hester and explained that I wanted to take care of this amount and set up payment arrangments(worst thing I could have ever done)that is when she had explained that the amount was now 881, and that my husbands account was getting ready to be sent to their legal department for collection and that they would start garnishing his wages if the amount was not paid by the end of the month.

deniseHester said that they would settle for 1/2 payment and they would match dollar for dollar, so I set it up, but on 6/15 I called and told her that I wanted to pay 220.44 and the other half at the end of the month, and that is when she got an attitude and told me that if I cancelled any more payments that I would have to pay the balance in full or else they would turn it over to their legal department. they haven't yet but they are constintley updating my husbands credit report, even when there hasn't been any acitivity since June 19.

Well we never received a bill in the mail from AAC until I called and now they have reported on his credit report to make it look like a new debt and are claiming we are 120 days late on a payment, how can they get away with something like that?

Amanda,

If you did not owe the money, WHY would you call them to arrange payments? This is crazy!

Did you ever hear of the word DISPUTE?

The "legal dept" does not exist. It is an intimidation tactic to extort money out of you.

NEVER speak to ANY collector on the phone! This is exactly where it gets you.

It is a NEW debt NOW, as YOU Re-affirmed it by making a payment agreement. You restarted the 7 year reporting period AND the SOL, which previously was expired and the debt was uncollectable.

STAY OFF THE PHONE.

I believe they can now that you called to set up a payment schedule. It was the worst thing you have done, I think you allowed them to start the debt all over. (making it appear to be a new debt)

I think you should contact a bk lawyer, they help in credit matters like this also. I think you might have to pay either way, but at least a lawyer will advise you how to respond to them without digging a deeper hole. Plus if they start threatening you, or lying you can report them and possibly sue them so they owe you money.

Good luck, don't let them get away with it! Even if you legally owe the money, they can be such scum when they try to scare you into paying.
