This is a long story; I am going to do my best to tell it all and welcome any and all feed back.

In January, 2007 - I started dealing with this company on my mother's behalf. Her home was in foreclosure, she became ill and I was in the process of buying my own home. After learning my mother's fate I forfeited my plans to help her.

On February 6, 2007, a payment modification plan was set in motion. I had to wire over $3000.00, by February 7, 2007. I did so and 6 monthly payments over $500.00 were to be paid by the 7th of each month there after.

At the end of the modification plan - I was told we would receive time dated materials by courier. In August we did not receive anything. Not knowing how long it would take I continued to pay the scheduled monthly payments in September and October by the 7th.

Toward the middle of October, I received notice from Western Union that the payment had been declined. I then contact ASC - only to be told that the house was back in foreclosure and scheduled for sheriff's sale November 14, 2007.

After contacting them - I was told that the new modification could not be done because of the unclear title. In the beginning of this agreement when talking to their representative I asked them if I could be put on the loan - I was told no due to the delinquent status. I advised them that I wanted to be able to secure some interest in the property, so if something happened to my mother who was now in the hospital to have surgery, I would be covered. The representative told me that I could look into a quit claim deed but I could not be placed on the loan - so I did. The quit claim deed was filed on February 7, 2007 - I had no idea that this would be a problem, especially since their representative suggested it.

We obtained a lawyer to see what could be done. We were given several options and made arrangements to do what they requested. I was to pay $1255.00, change the title and pay 2005 taxes that were supposed to be paid out of my mother's escrow. ASC was not the originator of this loan and could do nothing about the previous agreement concerning the taxes.

We agreed to do this and I requested this agreement in writing. After agreeing to put it in writing and fax it to the attorney's office, I did a three way call which included the attorney, myself and a representative from ASC. The agreement was confirmed and we asked for the agreement that I was told could be faxed to the attorney and this time it was denied.

The attorney and I were both skeptical and I did not complete the transaction for fear of loosing more money and not having an agreement.

On November 14, 2007, the house went up for sale. About a week or two after that we were contacted by a real estate representative from Reality Executive stating that we needed to vacate the home in a couple of weeks. She contacted me again and said Wells Fargo is offering $1000.00, to vacate the premises. I then told her I was going to fight this to the end. She asked me for a copy of the documents I had the copy was provided. My family and I was facing being homeless for the holidays and I wasn't going to give up that easy.

I contacted the agent again and she said she could not talk that was before Christmas and we still have not heard from anyone yet. However, we received notification that the insurance that was placed on the property by ASC, would be cancelled because the property was now with another company.

I filed a complaint with the BBB. I also sent this story to several major and local news stations, our mayors office as well as the Oprah show. I have not yet heard from anyone except the BBB and I received a copy of ASC rebuttal.

They are saying that we were late paying March 7, 2007, payment. In accordance to the modification plan we could not be late. I have every Western Union receipt. Not only were we not late I wired the money on the 6th of March and confirmed that payment was received by Lee a representative of ASC.

The second thing they said was on August 8, 2007, the modification plan could not be extended due to the title issues. Why were we never notified and why did the take the September 7, 2007, payment that was outside of the original plan?

After I contacted them in October, we received notification from their attorneys office, dated October 30, 2007. What ethical company would not notify you? ASC/Wells Fargo is the answer.

I have prepared a rebuttal to their answer and I am sending it to be BBB with all necessary documents to prove our case.

My advice to anyone doing business with them get out NOW and if you are not doing business with them DONT!

I dont know what is going on or what the future holds for me and my family. I do know that I will not stop fighting for justice in this matter. We are still in the property no one has returned our calls and I am not giving up.
