For the past 7 months I have applied for a loan modification and followed up with several phone calls to them just to find out that they either have closed my file for ridicules reasons like documents provided to old, according to them a loan modification process takes about 4 to 8 weeks so of course the documents are going to be 2 months old by that time, but this guys do not bother to call or email me to provide new documents before they close the files, but since them I have applied about 10 times and every time they either loose my paper work or something else, every time I call I get different responses and answers to my questions.
time after time I have asked this people I like to keep my house all I need is a little help from them to modify my loan for me, they will say yes sure we are here to help just fax in your paper work for modification and we will get back to me.
but during the many times I have faxed in the documents never I got a call or a responce from them.
I am not so sure any more, I do not trust them at all, I think sooner or later they will put me through foreclosure and I end up loosing my property.
if any boy is planing a class action lawsuit against American Servicing Company count me in I am up for it.
this people are incompetent and has no seance of honesty and integrity.

We Need A Class Action Lawsuit

Wells Fargo is the most unresponsive and incompetent company I have every had to work with. They have a complete disregard for truth, lie consistently to get your business and, once they have it, continue to lie to keep it.

In my case, I went with them for a home mortgage because of the GUARANTEE they have on their website (i.e. we will close the loan by the date that is set or we will pay the first month's mortgage and principle). Then they refuse to honor that guarantee even when you can prove, beyond a reasonable doubt, that you have met all of the requirements on your end and that the close is late as a consequence of their total and complete incompletence (which they readily admit to by stating that "we are extremely busy" and "we cannot handle all of the requests" and the like.

If they were honest with me up front, and told me they were overloaded and did not make promises they knew they would not keep, I would have gone with another bank that I have worked with before.

Bottom line: Wells Fargo has caused us harm far above and beyond simply not closing on time. They have put us through an emotional 'hell' and I am going to attorneys to begin a class action lawsuit for breach of contract which will also include compensatory and punitive damages.

In additon, I am putting together a letter writing campaign to be published in are local papers (Orange County Register and LA Times). This will make a great human interest story because there are thousands of us who have paid our taxes to bail out banks like Wells Fargo only to have them come back and demand more.

Please let me know if you are interested in being part of this lawsuit.

They could not care less

The simple answer is that neither Wells Fargo nor other mortgage servicers are really interested in modifying your loan - they have already sold your mortgage and now are simply collecting money... basically for ignoring you. And guess what, they get paid a good "lump-sum" (based on their servicing contracts) for foreclosing on your home. So tell me again, why would they care to find your documents???

For everyone that is as upset as I am at this whole situation with getting run-arounds resulting in nothing even close resembling even an effort to modify our loans, please go to mbscollateral website.

The website is designed to facilitate discussion and organize efforts to start a 'consumer' fight from a different angle - uniting many homeowners in similar situations and collectively approaching Wells and others. They can easily 'blow off' you, but if there's a 1,000 homeowners like us coming together... then a conversation would be A LOT different (think of it as 'homeowners' union').
