Ok let's get started. I basically have the same problems that everyone else has been faced with dealing with this company. I have a chapter 13
bankruptcy which makes life even harder. First of all it is hard to pay a trustee x amount of dollars in the bankruptcy anyway and then try to keep uo with the post petition mortgage payments as well.. I did the best that I could do but could no longer make both payments as I also have a balloon payment to make as well. Even though the trustee gets paid thru a wage earner. I miss a good chunk of money coming out of my paycheck monthly. Nonetheless ASC went to court to have the automatic stay lifted and of course the judge approved, so that put my house back in foreclosure, for the second or third time. Anyway this company has there attorney's contact my attorney approximatley 3 weeks ago and wanted to do a possible workout plan to keep the house out of foreclosure, so I complied sent them back everythinig they wanted, so now I sit and wait. (Keep in mind tht I was just gonna walk away form the house) so after waiting 2 of the weeks, oh and my foreclosure is on the 21st of Nov. yes the day before Thanksgiving, I decided I would do some following up, but not before I discovered this wonderful investor who wants to buy the property for what I owe on it and nothing less. So he and I are on the phone, all day Monday got transferred to about five different departments just to get nowhere fast. We are trying to postpone the foreclosure long enough for them to review and accept a short sale for the property. I don't really know what else to do and I'm getting more and more frustrated with the whole situation, so they would rather not work with this gentlemen take a loss helpo me to ruin my credit more and not even consider A WORKOUT OPTION. Right now I'm just a pissed off person.

If you're willing to take what you owe on the house for the sale thereof, and assuming that you don't have any other properties or big ticket items (luxury cars, etc.), you should talk with your attorney about converting your Chapter 13 to a Chapter 7.
I don't want to get into any further details, as you are already represented, but bring this up to your attorney and see what his thoughts are.
