I had called the Check Smart store named above to tell them I would be making a partial payment to them on July 21. This was noted on my account.
"Corporate" office called me on July 18 & 19 demanding that I pay my loan in full with "no excuses".
July 19 at approximately 8:36 A.M. A voice mail was left on my by an unknown caller stating in a very rude voice, "Laura, Corporate Office, Check Smart....Stop with the excuses and just show up" Then he hung up.
When I called him back I was told that if I did not pay the whole amount that they would..."Prosecute" me for check fraud.
This man along with someone named "Mrs. Gold" have both indirectly threatened me with criminal prosecution.
I have filed a complaint with the CFSA.
Which reminds me too that this company also charged me a $2.00 fee for rescinding a $200.00 loan. This was also reported to the CFSA.

I have also dealt with this company and a similar situation. I took out a payday loan, had an issue with my bank account, and the check was returned. Their corporate office is ruthless in collection, but unfortunately there are not violating FDCPA. They are considered a "first party" and are excluded from FDCPA which applies to "third party" debt collectors or agencies. Basically, they can call you anytime day or night as many times as they want. The best thing to do (if you haven't already) is to pay off the debt. Though this may seem unfair, they take full advantage of a small loophole in the law.
My advice to you is not to get wrapped up in these loans in the future. It's a terrible cycle designed to keep consumers stuck on a merry-go-round. Contact your state government and voice your opposition to these establishments.

I just want to state that I work for one of the checksmart stores in OH and I tell my customers on a daily basis that if they are going to bounce a check that I understand. I also tell them NOT to contact corporate they are very cruel people. They are like that to the people working in the stores who want to help our customers. We are the ones that see these people every two weeks and know them. I am very close with some of my customers and I myself Have been cursed at and told I was worthless in much more offensive terms by our collectors. The reason being that I was on the phone for a customer that had bounced a check trying to set up a payment plan for her because she had just had a baby four weeks before and her husband was killed in the war. I know this because I was at his funeral. I care very deeply for the people that come into my store most of the tellers do. I want to help them find ways out and I am willing to sit and try to educate them on effective ways to escape the payday loaning circle. Talk to your tellers we do care!!!! We hate the collectors as much as you do in most cases. There are a few good ones up there. Always be honest with us ~ good phone numbers and work info, keep us updated and we will try to keep the corporate monsters off your back. As for Mrs Gold who is stated in one of these I have spoken with her on many occasions and she is NOT a nice person. I am so sorry for your experience and wish that I could have been there for you at the time.

It is now August 4, 2007 and has been one week since I paid my loan off with these people. They still have NOT mailed me my cancelled check. They want blood...well, I will personally see that they will not treat any body else this way. I had called their corporate office and spoke with "Elizabeth" who told me that my check had been mailed on Wednesday, August 1. I want some type of form stating that this account was paid in full. Their receipts just show amount of money paid but no documents whatsoever showing "PAID IN FULL".
CFSA wrote me yesterday and they are forwarding my letter to the president of checksmart. Now it is just a wait and see thing.
