Granted, I have been unemployed and receive no compensation and have not received any compensation for over a year.  I have exhausted all my savings regarding my means to survive and can no longer pay my creditors.  I have been living in the house which my husband owns, and we made the decision when the savings had been drained that I would forego paying my creditors and being that he was still working, he would continue to pay for the expenses that we needed to survive.  I fuly intend to repay my creditors once I am back on my feet again and am employed.  I have written letters to my creditors and have talked personally with them and informed them of my situation - and that it was noted on my account(s).  I realize that this sounds like a cop out - and I know that I am responsible for these things, but when these accounts are turned over to collection agencies as a means to recover the money - what gives these collection agencies, specifically CPC - Central Portfolio Control - to think that their way of "handling" these situations by calling and harassing their "clients", and threatening them into paying on these accounts or else they will be listed as "refusal to pay" - which is not the case! I know that collecting is part of their job, but they really don't know what it is like to NOT have a job and to be down and out in their life - and then to have someone call you and yell at you and interrupt you and not even pay attention to ANYTHING that you are saying.  I am so upset at this point that it is truly difficult for me to put into writing what this company is capable of.  I know that they are just doing their jobs, but I think that the tactics that they use  need to be addressed!

Screw collection agencies

Screw collection agencies & creditors.   They both are out to ruin us,   when you have fallen on hardtimes.   They are all bastards.   I have all I need,  so them putting something on my credit will not hurt me.

Because I am not applying for credit anytime soon.   So these assholes think they are ruining you,   buy putting you late or putting a collection on your credit.   But If you have a home or car to drive that Is all you need.

All collection agencies should be closed,   hell they even steal money from creditors.   They keep all the money to themselves.    So the collection agencies,  & they don't even pay their bills.

Not one single collection agency should be trusted,   they are all evil snakes.  

The federal trade commission doesn't do enough,   to be more harsh on collection agencies.

Sure they might fine a few of them,  but they go back doing what they always do.   Ruining people when things happen we cannot control.

So this Is to all a*****e collection agencies,   go ahead ruin my credit.   I have all I need.    Ya'll hate us well the feeling Is mutal.   I hate you to.

I'm sorry to hear that you've fallen on hard times, but this is pretty much what you can expect when your bills go unpaid. Merely telling your creditors that you will pay them back someday will not work for long. They will eventually turn you over to collection agencies and you can expect pretty much the same type of behavior from all of them. The main reason they operate this way is that it often works. People will eventually pay them to get them off their backs.

 Actually it is the case. You may have good intentions, but if you don't pay, that qualifies as a refusal to pay.

  Since this is a third party collection agency, you do have an option to get them off your back using a "cease communications" letter. Check out the following FTC page for more info about your options :

Collection Agencies hear "I want to pay my debts when I am able, but I am not able right now because of..." dozens of times a day.  More than a handful of those people have zero intention of paying taking the risk that the collection agency won't decide to sue them.  So these agencies could care less about your financial situation.  In fact the more you tell them the more that they may use against you if they ever do sue in order to collect the debt.  For example NEVER give them access to your bank account(s).  If they don't have your SSN do not provide it to them, if they don't have your work information don't give it to them.

As you said it is their job, but they do have specific laws they must follow.  The main one is the Fair Debt Collection Practices Act(FDCPA).   It may be good to read this over to know your rights.  Because if they violate it you can take action against them to file a suit.  But you do have to be careful.  Because if the debt is yours and they can prove it, and you do sue it is very possible that they would counter with a suit on their own for the debt instead of just sitting on it.

If you do not want them to contact you anymore you can write them a "Cease Communications" letter.  This will not stop them taking further action, such as filing a suit or transfering it to another collection agency.  It just keeps them from contacting you, unless it is to tell you that they will stop contacting you or that they actually have filed a suit.  They also can't make threats of actions that they can not take.  This would be things such as threatining jail.

Don't let things such as "refusal to pay" worry you, as I said it doesn't matter.  As they could care less if you refuse to pay or that you say you want to pay but can't.  Your credit report will list the collection account, there is no separate listing for "refusal to pay".  Also, if you start hearing words such as "Pre-Legal" that really can mean anything but rarely means they are planing to sue you.  It is just a fancy term to try and scare you into paying.
