On March 15, 2009 Delray Credit Counseling took a $650.00 payment from my bank account after they were informed not to withhold the payment due to our lack of funds. The note that the "customer service representative" noted our account that once he informed that we could be dropped from the program" he claimed I told him that I would think about it and call back. There was no way that I made that statement because I would not have been able to pay the amount and I told him that the creditors would have to "do what they had to do."
Because the account was noted by "Lucas" and his supervisor back him up, Delray took the money from our account and noted that because I did not call "Lucas" back that the payment was taken. At that point Delray cancelled their "return check fee", however, I was left with a $35.00 overdraft fee to our bank. On April 13, 2009, as requested, by their customer service department that I forward a Client ACH Change Form to start my payments again.
I forwarded the Form and requested that my payment be taken on April 17 and faxed it on April 13. They altered my "ACH Change Form stating that my Form stated that the payment be taken on the 11th. I noted that I sent the Form on the 13th so they could not have taken the payment on April 11. In fact they did not take the payment until the 14th. I have my original document and I requested that the fax which stated the "11th" be sent to me. Again, it was clearly altered.
Upon entering my back account on the 14th Delray took their payment, causing my mortgage payment to be returned for insufficient funds, the cost of a returned check charge to my mortgage company. Since my mortgage payment and Delray's payment both were received by the bank on the 14th, my bank returned both items. I have now incurred additional fees for their lie and alteration of my paperwork caused returned checks at $35.00 totaling $70.00. Payments on my account had been taken on the 17th of ever month since August, 2008.
I requested that my total return check in the amount of $105.00 be refunded. I was treated very rudely by customer service, I was told supervisors would call me back, only I never got that call. I was threatened that I would be dropped from the program. I am now reporting them to the Consumer Fraud Protection Agency which in Delaware is located within the Attorney Generals Office of the State of Delaware, Better Business Bureau; and I am suing them in the Court of Common Pleas of the State of Delaware.
I am suing for $105.00, interest, court costs, and for punitive damages in the amount of $1,000.00. Please, do not use these people they are nothing short of criminals. I wil advise as to the outcome regarding information I receive from the above listed agency and my success in suing their butts off.
