Starting Nov., 2004 I began getting late notices on my mortgage statment. I have made all my paymenta and spent hundreds of dollars on calls and faxes of my cleared checks, bank statements. I have been through every hoop and stii EMC shows me 2 months past due.
I gave up the fight for a time and a few months ago, I went ahead and paid an extra payment. EMC still has the calls several times a day and they claim that the payments have not been made. The standard line is "your checks and statements do not prove that we were paid, only that the money came out of your account. It does not prove that we were paid."
By the way, I have been paying monthly with bank certified checks since Jan.2006.
I dont have the extra income to hire an attorney to try to get a few thousand dollars. I would love to have any info. on a class action or an attorney willing to do contingent work.
Stay away from EMC! I wish I had, now Im stuck

Hello, I have also been ripped off by EMC Mortgage. I was first finances through Freemont Investment and loan then our loan was sold to EMC mortgage, since then it all went down hill, we had an adjustable rate mortage (which I suggest no one ever gets if they can help it!) I was young and had no credit is why I was suckered in. Anyways, our payments went from $847.00-$1,600 in 7 months!
How? Why? I tried to refinance and talk to them about this but the more I tried to get something done the worse the situation became..I had "lates" showing uop that I didn't have, making my credit look aweful. On top of that a $50 late fee every month, we are now in foreclosure b/c of this. I just don't understand why they would do this. Please keep everyone posted on a class action lawsuit, I am in!

I TOO HAVE EMC AS A MORGTAGOR, NOT BY CHOICE. SINCE 1999 I HAVE ONLY GOTTEN A TOTAL OF 12 STATEMENTS FROM THIS COMPANY. THEY HAVE PUT US IN BANKRUPCTY AND FORECLOSURSE, BY COMPANY MISTAKES, NOT OURS. I TWO AM LOOKING FOR SOMEONE TO HELP START A CLASS ACTION LAWSUIT AGAINST THIS COMPANY. THEY ARE NOTHING BUT A RIP-OFF AND HEACHACHE WHICH NEEDAS TO GO AWAY.
