Festiva presented their vacation package to my wife and I in January 2011.  Given the amount of traveling that my wife and I do, it sounded like something we could benefit from.  I wanted to take some time to think about it, but the sales agent and manager were very persistent, and threw in added features if we would sign up that day.  My wife and I were on our anniversary and were trying to hurry out to make an engagement we had booked, and didn't have time to go through the hassle of having to wait for the sales rep to get his manager every time we said no to the package.  Finally, I asked if this didn't work out, could I cancel, and they said yes.  I did the paper work as quickly as possible so I would make the reservation deadline of our next event.  A month later, my wife tried to book an event, and was denied.  She later tried 4 other times, and still had no luck.  She tried calling Festiva, and only got the run around.  At that point, I decided to take Festiva up on their word, and cancel the agreement.  To my amazement, they told me we could not and that I was liable for every cent.  We never used the service, not at our own fault, and we were lied to.  I stopped payment on the company leaving me where I have paid them about $1500 for a service I never received.  I later found out that their had been a lawsuit with them regarding this very same tactic years ago where they were required to pay a settlement.  At this point, they have charged it to my credit (the first thing to ever go against me).

Dear original poster,

I am currently gathering information regarding Festiva here in Asheville, NC. I'm working with Occupy Asheville. Please send an e-mail to outreach@occupyasheville.org, so that I may learn more about this company. I wish to document and discover local companies that engage in malpractices, and Festiva appears to be one of such companies. Thank you,

Victor Ochoa
