My husband and I signed up with Freedom Financial Management about 14 months ago to help us get out from under our credit card debt. This company claims that they will settle your debts for less money then you owe and will stop the harassing phone calls from your credit card companies. They supposedly sent out letters to all of our debtors and we were told if they called to refer them to a special phone number we were given. We were paying them $218.00 a month that was directly debited out of our checking account. What we didn't realize was that for the first 3 months, the entire payment went into their pockets, then from month 4 -13, $109.00 of it went to them and the rest went into a "Savings Account" that they held for you to settle your debts. According to the contract we signed with them they are not to settle any debts without first contacting you and getting your approval on the amount of the settlement offer. In the 14 months that we were with them, they settled only (1) one of our debts and unfortunately, they did not bother to have it settled as paid in full good standing, so even though it is paid off, it is still a negative on our credit reports.
On August 19, 2010, I called them to see how much money we had in our "Savings Account" and where we stood with paying off more of our debts. This is when I found out that after paying them $218.00 a month for 14 months, we only had $448.00 in our account, not including the payment that was just made to them on the 17th of the month. So on August 20th, I faxed them a letter cancelling our account with them and in the letter told them to cease and decease with any further actions on our behalf with our creditors and to send us back all monies in our "Savings Account" with them. Of course they called me and tried to convince me to stay with them, I refused and demanded that they return the money they had "SAVED" for us. I was told that our account was cancelled and I should recieve a refund within 30 days.
Today, I recieved a call from a "Representative" for the company named Shay Garrity, who told me that they had "Settled" on another debt on August 23, 2010, even though they no longer represented us, and NEVER called me to get approval to settle the debt. I lost it!!! I told the representative that as of August 20, 2010, they no longer represented me and had NO RIGHT to settle ANY debts on my behalf and that what they did was Fraud and Theft since I cancelled my contract with them as of August 20, 2010. He agreed and said that he had looked into this issue before calling me, that he had spoken to his supervisor and that the company was going to refund me what was in my "Savings Account" as well as the additional money they settled the other debt for. He said that I would get all of my money back and that since "THEY" made the mistake of settling the debt without approval, that I got a debt paid off for free.. I told him "Not Really" since they had already scammed us out of over $2,000.00!!!
Two hours later he called me back to let me know that the company was NOT going to refund me the money for the debt that was settled AFTER I had cancelled my contract. I told him that was UNACCEPTABLE, and asked to speak to whoever was in charge. After 20 minutes of trying to placate me I finally got him to transfer me to the Director of Operations, Carmen Viramontes, who is "In Charge" just under the CEO of the company. After explaining to her that what they did was Illegal since they no longer represented me after August 20, 2010, and they had NO RIGHT to settle a debt for me without my permission on August 23, 2010, she gave me a line of BS and said that they would only refund me what remained in my "Savings Account" and they would also refund me the additional FEE they charge when they SETTLE a debt. I told her I would be seeking legal representation since they defrauded me and stole money from me and she HUNG UP ON ME!!!
I called back and asked to speak to her boss, and was told that was the CEO and he was not available but I could leave him a voice mail. After 20 minutes on hold waiting to be transferred to his voice mail, I hung up and called back. I asked the person who answeered the phone what the name of the CEO of the company was, and she told me that "She was not allowed to share that information". When I asked her why, she said it was because the company was going through some changes and she could not give me his name, but offered to personally give him a message (SURE!!!). I gave her my name, account number ad phone number and asked her to write the message to him that if I did not hear from him within two (2) days, I would be looking into filing a suit against them for Fraud and Theft. She repeated the message and promptly hung up on me!!!
This company is a SCAM!!!!! They take your money, they do NOT settle your debts, and if they do. they do not do it properly, they will steal your money and defruad you and your credit card companies as well. BEWARE!!!
I would LOVE to start a Class Action Lawsuit against them, and am looking into how to do this.

Peoople like the one who commented on my original report rub me the wrong way, because as they stated, they may not work for this company that I filed the report about, but they do work for a similar scam company!
For further clarification, the contract that my husband and I signed, stated NOTHING about fees up front.. It actually stated that the fees would be taken out as accounts were settled! NO WHERE in the contract did it state that ANY of our money would be used to pay fees prior to an account being settled.
Before you go shooting off your mouth about something you don't know about and being rude and obnoxious, why not look into the companies BBB profile and see what they have done to hundreds of people.
As for your ignorant comments about us putting ourselves in debt, yes, we were in debt, thats why we hired a debt consolidation company Duh... BUT Freedom Financial by breaking their contract put us even further in debt by lying that they would be able to get all the late fees and over the limit fees taken off, and instead pocketed our money from the start and did NOTHING to save us money, only cost us more since 14 months of late fees and OTL fees where still being charged after they said they wouldn't.
As for your comments about getting access to our "Savings Account", which was with Global.. You are FULL OF IT!!! We NEVER were given a PIN or even a phone number for the company that was actually holding our money!
So before you go running your mouth off about a CONTRACT you've never seen, how things work, and how weknew exactly what we got ourselves into(Since You Are In The Business Of Scaming People Too Obviously) maybe you should learn to NOT be so self rightous and maybe ask some question before you jump to conclusions!!!
And finally, just for your information... I was not looking for a quick fix, or some magic spell to make all my debt just go away... I THOUGHT I was working with a legitimate debt consolidation company that was going to help me get out of debt, not further into it.
So next time you want to put in your two cents, why not ask some questions first instead of jumping to your own conclusions. Your post was rather rude, obnoxious and ignorant.
Hope you have Happy New Year Too, and try not to rip to many more people off since Karma can be a real B**ch! And it will come back to bite you in the end!

Debt Settlement

I have been in debt settlement for years in every possible position, sales, CSR, team lead, compliance , contracts. you name it.
I read your report and I must say that you were NOT blind to what was going on or what YOU and your husband signed. You can't possibly say that you were paying $218 a month to the company and did not know what was going into the fees . YOU are given a contract to review and SIGN both you and your husband and in that contract it would have indicated the fee schedule and YOU and your husband were aware of it.
You can't sit there and tell me or anyone that magically you realized $109 was then going into your trust account?~ really? The first three months YOUR not going to have even enough to settle any of your account to any creditors think about it.. 3 months x $218 equals $654, so if you have a card that's 10, 000 and they say they can settle for 40 or 50% what would you need then? right??
Regarding the settlement of the debts as you indicated which had to have approval by you and your husband you must have READ in their somewhere about the FEES:?? right? it's funny that people only hear what they want to hear and see what they want to see. The reason for your approval is to have you sign off on the debt you have every right to say NO, which set's you up for lawsuits.
When your accounts are settled or paid to the creditor the CREDITOR is the one who reports the status NOT the settlement company. They can put whatever information they want.
YOUR negative on your credit report started when you and your husband got behind and could not pay, NOT the fact that the company settled the debt and then you had derogitory information listed on you.
YOu also would have had access to your account to see how much money was in your account.. the debt companies use Global client solutions or Noteworld and each client is given a password to their account.. And you would have initially been asked for the debit for your account each month.. this information WAS given by you and set up by you .. by YOUR signature..
So if I understand correctly you have a major debt that is owed you probably were in the program for lets say 36 or 48 months and after 14 months of time spent on your file, phone calls and negotiations you decide that you want all your money back because it's not going the way you want it to? Correct?
They wanted you to stay the course and stay your goal but you refused to help yourself. now your going to be in the same boat but in worse shape.
You are only allowed the money that is saved for your negotiations back to you ..
the debt settlement companies DON'T work for FREE~ I'm sure when you get your lawn mowed or get gas you pay.. it's like any other service.. you had a contract, you signed for the withdrawls, you had a fee schedule .
It's great that they settled another account for you right? Oh they had to have your permission I forgot.. :) either way you got another one settled and you did sign a power of attorney that would enable the transaction and coorespondence of settlement. correct? but now your pissed off that you did not stay your course, you think everyone is scamming you but you neglect to realize
you did this to yourself, your credit did a good job of getting you in debt and now you want some magic pill or magic bullet to get you out.. it's funny to me that clients and consumers are so quick to point the finger at others for their own shortcomings.. face it YOU have debt your in deep and needed help.. NO one scammed you . you had a contract you knew where the money was going and the rep advised you how long and how much..
deal with it.. debt sucks.
