In July 2007, due to unforseen circumstances I found myself overdue in my mortgage payments and was facing foreclosure proceedings. Believing in advertisements I contacted Home Mortgage Solutions and was immediately put in touch with Todd Knight who sent his representative, Jeff Moss to my home. Jeff explained that they could loan me the amount needed to "save" my mortgage and repay the "loan" over a period of time while ensuring that the mortgage company was paid as well. We agreed on a loan amount to assist me in catching up with my mortgage with the agreement that I could pay off the "loaned amount" at any time and eliminate the services of Home Mortgage Solutions at any time.
The agreement was for me to pay an agreed to amount to Home Mortgage Solutions, who would forward payment to my mortgage company on a monthly basis. All was working well, when out of no where in July 2008, I was contacted by my mortgage company. Unbelievably, my mortgage had been placed into foreclosure due to non-payment. The account was three months in arrears because Home Mortgage Solutions had not submitted payments, as agreed to, even though I had made payment to Home Mortgage Solutions.
In summary, I was making payments and honoring my obligation to Home Mortgage Solutions and they were not honoring their obligation to me or my mortgage company. I had to pay several thousands of dollars to bring my mortgage account to a current status and have kept it current from that day.
Additionally, I have detemined that during the time of delinquency, Mr. Todd Knight passed my "agreement" on to an investment company in Newnan, Ga by the name of Hines Investments under the ownership of Mr. Reginald Hines. In my attempts to discuss this matter for clarification I found that Mr. Hines is as illusive as Todd Knight. I received no response to my emails, phone calls or letters. After speaking with my attorney, the contract was deemed null and void as a result of breach of contract on the part of Home Mortgage Solutions.
Now, after 6 months of no contact and no resonse to my inquiries I receive a letter from an attorney representing Mr. Hines attempting to take ownership of my property.
Benita of Columbus, I need to speak with you. Please call me at (((ROR redacted)))

Response to factually inaccurate posting

AUTHOR: Todd Knight - (U.S.A.)

POSTED: Wednesday, March 11, 2009

I am going to provide only a factual response to this otherwise ridiculous posting.

1. The fact that you were in foreclosure because you failed to pay your mortgage as agreed is accurate.

2. The fact that Home Mortgage Solutions provided the funds to your mortgage company to prevent your foreclosure is accurate.

3. Home Mortgage Solutions filed numerous Dispossessory Warrants due to your subsequent non-payment. Therefore, your statement that you were honoring your obligations and all was working well is inaccurate as evidenced by the publically available records of the Muscogee County Magistrate Court.

4. The fact that your contract was transferred to Hines Investments is accurate. This was in accordance with the provisions of your signed and notarized contract.

5. I received no response is accurate, as you were provided written notification by both Home Mortgage Solutions and Hines Investments, not to mention being served by the Muscogee County Sherriff regarding your non-payment on an almost monthly basis.

6. The contract was deemed to be null and void is inaccurate. Attorneys do not have the authority to void a contract.

7. Reginald Hines is illusive is accurate. The very next sentence of your posting states that his attorneys have contacted you regarding your default.

In summary, the common denominator with the problems that you have encountered with your first mortgage company, Home Mortgage Solutions, and Hines Investments is your failure to honor very clear, written agreements and then to blame others.
