If you had Homeside Lending for your mortgage company then you already know how they screw you over. They lapsed on my escrow insurance and tried to give me forced placed insurance at twice the fee. They misplaced several of my payments that went through Bank One because I was never even notified that Bank One sold my mortgage loan.

Then they refused to take any of my house payments until as they said "they can figure all this out and come up with the amount that is missing" bullcrap! There was not amount missing but they refused my payments for over a year and send me a foreclosure notice day before Christmas!

After wasting several thousand dollars on an attorney that didn't really want to do anything but make a phone call to them, I ended up with the attorney general involved. Now there is a class action suit started in my state.

If you have been a victim of Homeside Lending, I would love to know about it!!

Hello-- get the Office of Thrift Supervision or your state banking office (it depends on the lender's charter) involved.

Both your old lender and the new lender purchasing your loan were required under RESPA laws to provide suitable notice to you on the changing of payment information. RESPA and TIL (Truth in Lending) are federal laws, you can get details in a search of the HUD website (www.hud.gov) or do an internet search under "fair lending " "predatory lending" "RESPA" and "Truth in Lending".

Glad to hear a class action is underway. I recently had an experience with a bank, and I reported them to every damned agency I could find. Let them jump through some hoops with their regulators for a change.

Please search this site for Fairbanks Capital and its amazing how much they and Homeside have in common. Are you positive that Homeside is a mortgage company or are they a servicer? You may peruse the remarks and post about Fairbanks and get some ideas on how to handle your mortgage company and maybe even what to do legally. They operate in similar fashion and thats a awful thought. Good Luck. Also do a google search on homeside there is a site already set up for complaints about them and postings from people having similar problems. Dont let them get in as deep as Fairbanks Capital has, they are the devil in disguise. Peace.
