I received a loan from TMS in 12/2005. After being thrust into the world of Mortgage Service Fraud, I have become very familar with this scam. I believe 100% that what these ex employee have posted is true. I am beginning a lawsuit against THe Mortgage Store. I have experienced Jason (CEO) rath first hand. He has threatened me if I posted anything about him on this site. I do know straight from his mouth that he is in litigation with the ex-emloyee that posted from Kansas City. The other employee from CO that he said was not his employee he is probably lying about as when I questioned him about the loan officer that originated our loan - he claimed not to know him either and he worked in the same office as him.
What I am looking for is information on the title companies that TMS uses. Are they tied into this scam also? And if anyone can give me information on Joe Heitkamp that worked in the Saint louis office. Any information would be greatly appreciated.
By the way when Jason sees that I have posted about him, he is going to respond with personal information from my credit report - which is not legal but from what I see he does not work on the legal side. Anyway there are some late pays and I don't have the best credit because of a bad divorce, otherwise I would not have gone to a Predatory lender in the first place.

I just also wanted to post an update on the ex-TMS. I know a lot of people have been bashing JR. I agree he can be an harsh boss, and made a lot of poor decisions over the years. But there are always 2 sides to the stories and a lot of snakes in the grass. A few names of Moiser comes to mind, as well as the other half owners John and his wife. From my last understanding, they are all currently under investigation from the FBI. It's not just JR that helped the company sink, but these other people were pretty low in some of the dealings they did. I will be posting some of the things I have collected over the years from working there. Has anyone else had the pleasure of working with these other people listed besides JR?

I worked for TMS for a couple of years. Last year I resigned in the middle of all their financial hardships. I believe that the biggest mistake I have ever made was working for that company. I cannot believe how long it took me to put all the pieces together. Yes, our paychecks bounced, and I never received my last one. Accounting finally told me it had been mailed 3 months later. I never received it. Then, when I asked for the one that was "mailed" to be voided and for a new one to be cut so I could pick it up, it couldn't be done. I know other ex-employees who never received wages that were owed to them. The latest issue has been no W-2's. I called the regional manager for advice or help. Of course there was no help, he only laughed at my troubles and said we were the same. Actually laughed at me! He has started his own company now. I can't help but wonder how that one will end... I have been trying to get this straightened out for months now. I've finally started contacting lawyers. Hopefully this year we will finally be able to close this chapter and move on.

Glad I'm not working there anymore

I was one of the few that was let go a couple of years ago. I'm so much happier not working there anymore. I wasn't aware of the extent of what was going on there, I just chalked it up to being another sales type industry (I wasn't involved in writing loans or dealing with the money). They let me go with no warning and tried to get away with not paying my earned vacation time and cafeteria plan from the previous year (that particular year the leftover money was supposed to be paid back). Luckily I managed to get what was owed to me and I was able to cut ties as soon as that check cleared and haven't looked back.
I hope the honest employees that were there made it out in time and that they've found happiness away from JR. Hey JY, way to knock up an 18 year old. How's your wife taking that one? Hope JZ in Denver is doing well.
JR went off on me once. Just Once. I let him know very quickly that I wasn't one to be talked to the way that he talks to his employees. I'm really surprised that no one put him in the hospital the entire time that I was there. It's a shame that the guy that shot his brother in Florida had such a bad aim. I didn't care for Don much either and made that well known.
Guys, Karma's a b!***. It comes around.

The Mortgage Store - Thanks for information on Joe Heitkamp

Thank you so much for the information on Joe Heitkamp. I just hope he is as upset as the rest of the ex employees to give us information on the loan he processed for us. I know that it was not on the up and up. Everytime I hear a commerical for The Morgtgage Store, I want to print all of this off and send it to their sales department. I don't think St. Louis Radio would want to be selling JR's tactics to their listeners. Again if anyone has any other information, I would greatly appreciate it.

I am a Employee and I have to say from the Current Employee and Nick that they are full of it. Nick was loan officer of the Month three months in a row for way he over charged his customers and laughed about it. He ripped all of his customers off. I was shocked that everyone signed. He didn't get ripped off. He got a $10,000.00 if not more Watch out of that. There is no such thing as a free loan but we do know when we are going over the line when charging customers. That other employee needs to leave if he thinks its so bad. These guys give us good guys a bad name

Thank you so much for your response. Please also check out or feel free to post on msfraud.org. Other ex employees might be going through some problems now - but in the end they will win. I hope that you are able to find another job. The interesting part is that we closed at Title America's office but they were not the title company that closed our loan. That is interesting. There is more but I know that Jason probably watches this board so I can't tell all that I know right now. If you have any other employees or ex employees that will help me please have them post here or msfraud.org. I fully intended on following through with a lawsuit against them and Homeq who wound up servicing our loan. It is all one big scam.

Looking points

I still work for TMS so you can understand my hesitancy to post on this site. I want to resign but am not looking for any problems. And there will be problems. I have heard countless jokes about what nick has gone through and my family is not in a place where I can take the stance.
However, I would like to give you some looking points for your case. Title America is a TMS/Jason Rauschelbach owned/operated title company. All loan officers are required to use Title America at all times.
TMS closes loans w/o licenses, steals money out of employees 401ks, doesn't file taxes appropriately, charges outrages fees, encourages borrower to take cash advances on thier credit cards to cover required reserves, takes liens off titles without proof of satisfaction, will have borrowers back date loan documents on the first of the month to count for the previous, has a close relationship with white-out on credit reports, and I believe whole-heartedly if you pursue this case you will win.
