My fiance, Kimberly Mcclone, contacted Nick Berardi of Berardi's Powersports LLC of New Castle, Pa on FB marketplace to see if we could come to their dealership and see a Raptor we were interested in for $5800.00, after communicating via text, we agreed to meet with cash in hand. (First mistake) Nick agreed to open the shop since it's closed Sundays since we were willing to pay that day. We showed up, took the raptor for a short test ride, (all on video) and we agreed to pay the cash if he could hold the ATV until we rented a truck to pick it up the next day.(We live almost 2 hours away , weren't even sure we were going to purchase the ATV so we didn't rent a truck to transport the ATV yet.)
Later that evening we received a text from Nick to show up Tuesday, he forgot that they're closed on Monday. We called on Tuesday, even sent messages and he claims we didn't give him any money. When we gave him 58 - $100 dollar bills, we asked for a receipt that day but said he would have a receipt/work order, etc when we showed up to pick up the ATV. His partner claims we would have gotten a title if we purchased the ATV, but if you look on Google reviews, other people haven't gotten a title for the dirt bike they purchased, can't legally get one. Probably cuz it's stolen.
Anyways, on the 19th, we went to the Shenango police dept, explained our case, they asked why we didn't get a receipt on the spot. My thoughts were they are a local ATV powersports dealer,how could they take our money and act like it never happened? At any rate, we had just received a 120,000 dollar inheritance from Kim's mom passing, we showed Cpl Garver (the investigator currently working the case) our bank records and that we aren't trying to make a fast buck by trying to scam a dealership. We have all of the text messages and messenger app messages, photos of everything, and any proof we had we turned over to cpl Garver. We posted a very unflattering Google review about their business practices, which is when we received threat's of legal action for slander if our review wasn't taken down immediately. No way. It's still up, among other dissatisfied customers with complaints of fraud and legal action against Berardi's Powersports LLC.
I ry contacting Cpl Garver every so often but he keeps saying it's an ongoing investigation, when he originally told me charges would be filed last October. Nothing is being done, and at this point we don't even care about the money, we probably won't be reimbursed anyway.
Stupidly I trusted someone who I thought owned a reputable, locally owned business. I was very wrong. When he promised me a receipt/work order when I returned to transport the ATV, I had no reason not to trust him. I'm extremely embarrassed and humiliated for what has happened, but I refuse to give up until all legal action is exhausted on our end. I filed a complaint with the BBB, but other than trying to get in touch with the attorney general, nothing has panned out. The only reason I waited so long to push this further is because Cpl Garver doesn't seem to have this very high on his list of priorities, so I checked online to see any other routes I could take to warn people that Berardi's is a fraudulent company,. It's strange, for some reason, their indoor security cameras weren't working the day we were there. Ironically, the one other time the cameras weren't working was when 2 high end dirt bikes were stolen months before our situation occurred. Wow they have terrible luck with that security company. My next step is to contact the editor, and crime reporters from the New Castle News to see if this is something worth warning people about. There's alot more to the story, for instance the video of us taking the ATV for a test ride when Nick told his partner we weren't there that day, and other remarks Nick made via text messages. Thank you for your time, I hope this is something that can keep others from falling victim to their illegal practices by known convicted criminals. Thank you for your time.
