Individual was deceptive starting with his name when I was told his name was Moises Phillipp and he withheld the fact he was a Dealer and advertised a vehicle on Ebay Motors as a low mile, rust free and garage kept classic car, 2012 Mercedes Benz SLK 250. He sent several Photos and several walkaround videos showing the car to be as advertised and when asked if the vehicle needed anything at all, I was told it was ready to go and needed NOTHING!
On Saturday, 10/19/2024 the vehicle was delivered by a transport company from sellers location in Florida to my residence here in Texas.
I was absolutley shocked when the vehicle was unloaded as it has clear coat peeling all over the vehicle that never showed up in photos or videos and it has rust all over the brake calipers and also shows possible mold in the interior in various spots.
I sent the following Demand Notice in hopes the seller would do the right thing but he has chosen to say he feels he did nothing wrong and he never realized the issues I've pointed out would be any problem?
See Demand Notice.......
Sent via Email to Seller.......
Please receive this as a Demand Notice based on all the texts and emails I've sent since receiving the 2012 Mercedes Benz SLK 250 Vin# WDDPK4HA4CF035130.
The vehicle was mis represented and not as advertised on either Ebay Motors or on your facebook page under Best Deals Auto Sales and Detailing. I am placing you on Notice that the vehicle has extensive clear coat peeling all around the full exterior of the vehicle, it has rusting on all the brake calipers which indicate possible rusting elsewhere as well and also shows signs of possible mold in the interior. All of these are possible signs that this vehicle has been involved in flooding or high water issues that have effected the exterior, the interior as well as most likely mechanical and electrical issues as time goes on. None of these issues were disclosed in any of your listings and all were conceiled in a clear attempt to hide these issues. I am Demanding either a full refund of both the $11,500 paid via wire transfer as well as the $1,250 in transport costs for a total of $12,750.00 and upon refund in full you can pick up your vehicle where it was delivered on this date, 10/19/2024. I will consider keeping the vehicle only after a full inspection of the vehicle to determine if it's a flood vehicle or not and to see what all it requires to make the vehicle as represented in your advertisement listings and your agreement to pay in full for any and all repairs and replacement required to make the vehicle as represented. In the event you elect to do nothing and stand behind your AS IS sales contract which involved Fraudulent Inducement and False and misleading claims and representations then I shall proceed forward with claims and complaints both civil and possible criminal if determined to exist wherever they may exist involving this False and misleading transaction. The seller has made it clear they intend to do nothing so I post this as Notice to other potential consumers to be aware of this situation in case you come across this seller trying to sell you a completely mis represented vehicle that they conceil any and all faults of the vehicle in an attempt to sell you a lemon. My advise is steer clear of Moises and his Dealership and be leary of any auto advertisement he may post on Ebay Motors, his face book page, Best Deal Auto Sales and detailing in Margate, Fl. or anyother advertisment method he may use in the Future.

#1 Consumer Suggestion
Sounds like buyer's remorse
AUTHOR: Flint - (United States)

I found the listing for your car and the pictures show quite a few defects if you look closely. The lack of closeups and the minimal photos of the interior are also suspicious. You haven't posted any pictures so it's hard to say how the actual condition compares to what's depicted.
The text description doesn't say anything about the state of the clear coat, it just says there are no big dents or scratches. Surface rust on the brakes is perfectly normal, that can happen from a few hours of being parked in the rain. That isn't what would be considered "rust", which generally implies body rust.
Florida is quite damp so none of what you are describing indicates that it was in a flood. The listing also mentions nothing about floods, so they aren't misrepresenting anything. Also, what exactly are "signs of mold"? Either there is mold or there isn't.
In my opinion, it's totally insane to buy a vehicle without seeing it in person. Sounds like you have learned a valuable lesson. Also, the vehicle history report shown in the listing indicates that this is a vehicle that came from an auto auction and is being sold by a dealer.
