Breach of Contract Letter

Reference to; City Scape Apartments – 6467 melody ln. Dallas, Tx 75231

As of [09/17/2019] , you have been in breach of our Apt Lease Agreement: [ On 09/17/2019 I,

George Montanye – Apt #2062 received a formal notice citing a new requirement for residents of City Scape Apts, described below;

CITY SCAPE APARTMENTS HAS CHOSEN UNITED TOWN TO DO THE TOWING OF ITS COMMUNITY. THE ONLINE PROGRAM BEGINS ON OCTOBER 15, 2019. EACH RESIDENT MUST REGISTER AT UNITEDTOWN. NET FOR YOUR PARKING PERMIT FOR SEPTEMBER 30, 2019. YOU WILL HAVE TO UPLOAD PHOTO OF PROOF (TITLE, INSURANCE, OR REGISTRATION) FOR EACH VEHICLE YOU WILL REGISTER. UNITED TOWN WILL START THE TRAILER OF VEHICLES WITHOUT PERMIT OCTOBER 15.2019. ALL MUST BE PRE-WRITTEN TO BE APPROVED AS A RESIDENT AND ACCESS YOUR ONLINE ACCOUNT. RESIDENTS WILL BE APPROVED BY SEPTEMBER 30, 2019 YOUR GUEST NEEDS TO NEED TO REGISTER AS A VISITOR TO BE ABLE TO ESTIMATE IN THE PROPERTY @ UNITEDTOWNS.NET IT IS YOUR RESPONSIBILITY TO INFORM YOUR GUEST THAT YOU NEED TO REGISTER ONLINE.

WE APRECIATE YOUR COORPERATION IN THIS MATTER BUT REMEMBER , ONCE YOUR VEHICLE HAS BEEN TOWED IT IS OUT OF MANAGEMENTS HAND AND YOU WILL NEED  TO CONTACT UNITED TOWN (214) 309-9100 TO RETRIEVE A VEHICLE THAT HAS BEEN TOWED, YOU WILL NEED TO COME TO 7054 S. CENTRAL EXPWY DALLAS, TX 75216

IF YOU HAVE ALREADY BE ENROLLED ONLINE AT WWW.UNITEDTOWN.NET/REGISTER ON WITH THE OFFICE YOU MUST RECEIVE AN EMAIL THAT IS NOW APPROVED. THE NEXT STEP IS.

This requirement is in breach of several clauses in the City Scape Apartment Lease Agreement;

This is a new requirement and was not include in the original Lease Agreement

[City Scape is adding a new or additional terms to the agreement contrary to its Lease agreement, with me, George Montanye “This Lease is the entire agreement between you and us.”]

Clause 18. Disclosure of information, City Scape may only provide rental information to law-enforcement, governmental or business purposes.

This requirement is in breach of several clauses in the City Scape Apartment Lease Agreement; This is a new requirement and was not include in the original Lease Agreement...  The problem with your argument of course is the parking requirement is not a part of your lease, since this requirement also applies to your guests who will come to visit you, park in the complex, and don't have a lease. 

Now, if the new requirement were to include a certain cost to register your car with a towing company, then yes that would be a problem.  However, there is no cost.  The other real problem you have is that if you fail to cooperate with the landlord on a matter such as this, then it is likely it would be a breach of your lease agreement.  That is what is being asserted here.

The question becomes this:  Would you have decided not to rent your apartment from this place had you known you would have to register your car with a security company with the ability to tow your car?  The answer to your question is obviously NO

The reason people rent apartments, or decide not to, has nothing to do with additional security for parking.  Whether it's low-cost, or high-cost, nice community, or terrible, they will either opt or decide not to rent there.  The only reason a person may opt not to rent an apartment that has to do with parking, is whether there is no parking for their vehicle.

You cannot obligate me to provide personal information to third parties.  Nobody is asking for your personal information be communicated to 3rd parties.  Your personal information would include your State DL, and your SS Card number.  Your personal information does not include your car title, your car insurance, or your registration.  Hilarious....  It's amazing what people think comprises personal information....

What is the problem??? Just do as they asked you to and give them the information simple as that. I see no breach of contract because they require that you submit information on your vehicle. If you do not have a vehicle then let them know. IF you do not have insurance then that is your choice. 

So if this is a breach of contract upload the contract. And NO I do not work for this agency.
