I have loaned Daniel Koye $33,750 USD to put his product on a reality TV show called RuPaul's Drag Race. We agreed to a percentage of product sales and interest on the loan. Two documents are signed and agreed on "GUARANTY AGREEMENT" and a "LOAN AND SECURITY AGREEMENT"
He works with Vanessa Wiliams, Heidi Klum, and has had his product featured on RuPaul's Drag Race. We have met several times to discuss future plans for his product. We also did a product launch party for his hairline, DKoye.
When it came to repayment, Daniel had problems paying back the minimum amount of the loan from the start. I did not mind, as I wanted to get the product to launch the right way. There have been issues on how to present the product Daniel Koye (himself) and DKoye (product). He wanted to treat each brand differently.
The marketing of the product started to become difficult.
In the end I just ask for repayment of the loan plus the interests gained over the years. I allowed him to pay a minimum amount as long as the payment was coming in, I treated it as good faith.
When it stopped I reached out to try to give him options and to discuss what he can afford. I gave him multiple options to pay with a payment schedule, reducing the amount to be paid back monthly, and even removing interest payment. In the end, I finally asked a set monthly or a fixed payment in full. This is when communication stopped.
I have tried to work with him but his personality is very tough to work with. My lawyer and I have attempted to reach out many times without any response back, even my lawyer that drafted the agreement was unable to reach Daniel Koye about this issue. He has ghosted.
I have given him the benefit of the doubt but it had to end up on here. I wanted to sue, the lawyer has suggested to find out financials first on his end first. It would be pointless to sue a person with no money he stated.
