(See Ripoff Reports #s: 1372260, 1163629, 1195118, 1154744, 1454692, 1279418, 1129198, 1116432), former or current HOA senior Board members and officers: William Bill Isabell as HOA President; Tony Bill Halstead, HOA Treasurer and/or Marsha Murphy, HOA Secretary. At least two of them were signors on the missing or elusive HOA bank account and had access to it. Apparent violations include Conspiracy, Fraud, Misrepresentations, Falsification of Records, Concealment of material facts, Bearing False Witness, fabricated false data to shift accountability away from themselves and falsely accuse and frame other unsuspecting owners as scapegoats, Loss or Disappearance of HOA Funds & Bank Account, failure to account for HOA missing funds and or Cover Up.

I represent the ownership of several condos and am former Board member in an HOA in South King County, WA, that has hundreds of owners and residents. Prior to writing this complaint, I tried my best to obtain relevant info and data, including copy of investigation summary on the missing funds by Dave Wescott and Kaarin Anderson, from the HOA/ Board/ managers in order to write as complete and factual summary of the events, bearing in mind to give them the benefit of the doubt.

My requests were ignored. Without the benefit of such data, they leave me no choice but to write my summary based on the information that is currently available to me. I invite them to provide me with the missing and requested information so I can update my summary where warranted.

Here I will share with you my experience, concerns and opinions in the hope that we can remedy the wrongs, learn from our mistakes and avoid repeating any continuation of negative actions. ISSUES (1) Missing HOA Dues Payments Via Electronic Funds Transfers (EFT) For many years, I made HOA dues payments via Bank of America (BofA) online banking to the HOA Bank, Heritage Bank, without incident.

The HOA alleged that it did not receive 5 months (August 2016 through December 2016) of payments totaling $6,405 even though I provided the HOA with copies of my bank statements showing recurring EFT payments deducted from my account and transcripts from BofA, showing the amount, the date and the EFT numbers for each payment, confirming that funds were transferred to the HOA’s Heritage bank account.

The HOA has denied receipt of those funds and although they assigned Dave Wescott and Kaarin Anderson to investigate the missing HOA dues payments, they still claimed that they found no evidence of my payments and claimed that they did not recognize HOA Heritage Bank account ending in 6155.

(2) Fraudulent Late Charges 72 entries over one year period The HOA/Property Management charged me $2,520 in fraudulent late dues fees against my condos for over one year even though I provided them with the BofA transcripts confirming all my BofA EFT HOA dues payments were paid electronically and on time.

The majority of those entries showed that HOA charged late fees even though their own records showed payments were paid on time. (3) Fraudulent/Unwarranted Liens 5 Liens On April 13, 2018, the HOA/Property Management placed liens on all my condos based on false and fraudulent representations in violation of my ownership rights.

So far, they failed to lift the liens and clear title. (4) Complaint to CFPB and Investigation by FDIC On April 9, 2019 I filed a complaint with the Consumer Financial Protection Bureau (CFPB), a U.S. government agency that protects consumers from financial abuse. CFPB referred my complaint to the Federal Deposit Insurance Corporation, FDIC.

FDIC contacted Heritage Bank who verified and acknowledged that I indeed made all 2016 missing payments in question and it shows it was deposited to HOA’s Heritage Bank account ending in 6155. Heritage Bank confirmation of HOA’s receipt of payments proves that the HOA Board and management deliberately made false statement of non payments.

Even after I shared copies of letters from FDIC and Heritage Bank with HOA and management and urged them to make needed corrections, the HOA, the Board and management have failed to respond. They also failed to provide copies of financial statements and other data that owners are entitled to and HOA is obligated to provide by law.

Conclusion It is of utmost importance that the HOA provide the home owners with answers to many Questions previously asked but remain unanswered and copies of data and reports previously requested but not provided including:

1. Why was the Board in denial of receipt of HOA dues payments and in denial of the existence of HOA bank account ending in 6155?

2. What happened to the missing funds $$$ and the missing HOA bank account that they still claim they do not recognize?

3. How much money was in the account when the Board closed HOA Heritage Bank account ending in 6155?

4. How do we know that all the funds were accounted for?

5. Who is really watching out for the benefit and interest of the majority of unsuspecting homeowners?

6. Did any other homeowner experience similar treatment or abuse?

7. Aside from my experience, was there any more HOA money unaccounted for?

8. Was I targeted because, as a former board member, I disagreed with the Board on some issue and decisions?

9. HOA to provide Financial data, bank statements, minutes for at least the past three years and copy of investigation report by Dave Wescott and Kaarin Anderson of the missing funds mentioned above and updated list of membership mailing labels that shows who owns what units.

All these should be available to any requesting owner. I wanted to share this information with the owners, however since the board failed to provide membership mailing labels after two years of requests, they left me no choice but to post my concerns and opinions in public forum.

Since 1979, I strived to work with the Board and owners in a positive and rewarding manner where possible. Owners, please insist that the current HOA Board and management are conducting themselves in a Transparent and Accountable manner starting with the list above and provide the owners with the relevant information so that owners, Board and management work in harmony in the best interest of their HOA for healthier community. With proper owners vigilance and oversight, we can turn our HOA around to recover its sparkle.
