I am composing this message in the hope of assisting others in avoiding the frustrations I faced after purchasing my first new construction home. I recently acquired a new construction home in an AIG Subdivision community through P.A. USA, LLC, a Florida Limited Liability Company (“Seller”), with the legal description of AIG Subdivision, and the developer is CONSTRUSMART, LLC, also a Florida Limited Liability Company (“Developer”). There are several companies with E & E in their name, and this one is E & E Design and Construction, located at 13155 SW 134th St, Ste 103, Miami, FL 33186.

To provide some context, I explored various developments including Lennar, DH Horton, and Maple Ridge. The homes were impressive both inside and out, but I had concerns regarding their locations. Upon discovering the AIG Subdivision, I was captivated by the exterior design of the homes and their location. After touring a particular home that I found appealing, I was eager to sign the contract, paid the deposit, and initiated the process immediately. I did notice that the homes did not come with mirrors in the bathrooms or closet systems, but I was aware that I would benefit from some savings due to buying advantages available to disabled veterans, so I proceeded. Throughout the building process, the builder, manager, and office staff were very friendly and responsive.

As the months went by, my home was completed. I hired a reputable inspector to carry out an inspection and promptly sent the findings to the builder’s office for resolution. The following week, I received a message indicating that my only walkthrough with the developer's wife/manager was scheduled for that Thursday morning, the day before my expected closing date.  Upon arrival, I immediately noticed that the stairwell required repairs on both sides. I also saw that many areas had been filled with putty but not sanded, caulked, or repainted properly. All of the windows had dried paint stuck to the inside edges of the window seals with cracking and poorly executed caulking. Additionally, it appeared that the walls had been painted hastily. It was clear that the painting was not done by a professional, or at least not by a skilled one, and the paint used was of low quality. Throughout the house, numerous spots were simply covered with putty to conceal imperfections, and there were other areas that required proper painting or finishing. I informed the developer's wife, who acted as the company's manager, that these issues needed to be addressed.

I pointed out that the inspector had noted many of the same problems in his report, which suggested that a qualified painting contractor should repaint the home. Her response was, “This is not a million-dollar home. Everything is not going to be perfect.” I thought to myself that it doesn’t matter what the home cost me! Furthermore, it is not a fixer-upper. However, I replied that while I didn’t expect perfection, I did expect the work to be done correctly. She assured me that her workers, who were working on another home in the same subdivision, would come over that evening to rectify everything, so I left believing she would follow through. The next morning, I received an email from my lender stating that my loan had been closed. Shortly thereafter, the title company contacted me to inform me that everything was finalized, and I needed to come in to sign the documents. Foolishly, I went without checking back at the home to ensure that the repairs had been completed first. After finalizing matters at the title company, I received a message from the developer/manager's wife saying she would meet me later that evening to hand over the keys. When we arrived, nothing had been fixed. I pointed out that their workers had not completed any repairs. She explained that they hadn’t had time but would come by the following week to make the necessary adjustments. She asked me to take a new homeowner picture for her, which I was hesitant to do because I was upset, but my partner encouraged me to smile and do it for her this time. I complied and noticed a power cord running from my home down the street. When I asked about it, I was informed that my home was being used to supply power for the construction of another home. I had to restrain myself, as this was outrageous.

I was paying a significant utility fee as part of my contract, and now my utility was being used for another home while mine was not being properly delivered. I had to mentally calm myself in that moment. I had been so focused on the putty everywhere, the poor paint job, and the necessary repairs that I neglected to check other aspects, such as the ceilings or floors. Recently, as I began moving small items into the home, I discovered soft spots in all three rooms on the second floor and the hallway. I noticed that the ceiling on the first floor has putty all over it, and some sections have an almost water-damaged appearance, so I am assuming that they did not properly sand or smooth the ceiling before covering it with what seems to be just primer. Additionally, the ceiling in the master bedroom is similarly affected. I am hoping that there are no other significant issues lurking beneath the surface of this home. This has been my experience with this company, and I sincerely hope that no one else endures a similar situation.
 
In sharing all of this, I want to stress that this was my first home and a significant milestone in my life. It has been tarnished for me. I will never experience that moment of joy when stepping into my first property. Don’t misunderstand me! I am incredibly grateful and blessed for this opportunity, as many others are not as fortunate! I recognize that numerous people around the world face serious challenges, and I pray for their healing. However, I regret that I was deprived of my moment because this company failed to deliver what I paid for and what I deserved. I hope others do not make the same mistake by being overly patient and kind. I was somewhat naive in trusting P.A. USA, LLC, a Florida Limited Liability Company (“Seller”), with the legal description of AIG Subdivision, and the developer is CONSTRUSMART, LLC, also a Florida Limited Liability Company (“Developer”). There are several companies with E & E in their name, and this one is E & E Design and Construction, located at 13155 SW 134th St, Ste 103, Miami, FL 33186.

To anyone reading this, please let my hard-learned lesson prevent you from making the same error. This is not the time to be passive or overly trusting, as I have learned through this process that individuals will communicate with you and make promises just to close a deal. Now, I'm left with the task of getting the repairs done to the floors, walls, stairs and stairwell, ceilings, etc. You should never sign anything until all issues have been resolved. If possible, work with a construction law attorney or real estate attorney during the home building or buying process. I regret not doing so! I certainly would not recommend or engage in any business with E & E Design and Construction, located at 13155 SW 134th St, Ste 103, Miami, FL 33186, operating under P.A. USA, LLC, a Florida Limited Liability Company (“Seller”), with the legal description of AIG Subdivision, and the developer is CONSTRUSMART, LLC, also a Florida Limited Liability Company (“Developer”) again.

 Being DEFRAUD socks, doesn't it???? People who DEFRAUD others should be forced to repay and spend jail time, don't you think? So this is what happened, right,? You accumulated late payments, maybe even a repo or even eviction over the years. Somehow, you heard about this place and for a price, they told you they could make all that go away but there's that matter of FRAUD and DECEPTION which prompted you to write your report. If everything went as you planned and hoped for, all the bad stiff on your reports would go away, and any future creditors to whom you would apply for credit would see a "brand new you". You were hoping and wishing these people would create a new identity for you. The new creditors wouldn't see the REAL you, but a FAKE you. YOU would have DEFRAUDED and DECEIVED them into thinking you were somebody you most definitely were not. You are a verified and documented deadbeat and now you come here to cry and whine because you were DEFRAUDED which the exact same plan you had in mind when you paid these people to put you behind a smoke screen. Yes sir, FRAUD and DECEPTION is tough and you were prevented from victimizing another creditor. Isn't THAT such shame!!!
