Subject: Request for intervention regarding unprofessional conduct by a VR&E Counselor

Dear Mr. Francisco Paz M.S. Supervisory Vocational Rehabilitation Counselor,

 I am writing to formally bring to your attention an ongoing issue involving one of your counselors, Mr. Mauricio Solis, who in my view has demonstrated an unprofessional and bullying attitude in his interactions with this veteran. This behavior has undermined the trust relationship, creating a hostile and unproductive environment that is obstructing the veteran's journey towards gainful employment in the IT industry. 

As documented in a series of email exchanges beginning July 5th, 2023, the veteran has expressed his lack of trust in Mr. Mauricio Solis and requested a change of counselor. Rather than handling the situation professionally, the counselor continued to communicate with the veteran in a manner that can be characterized as dismissive, confrontational, and ultimately, unhelpful.

One specific issue, of the many documented, revolves around the counselor's inconsistency in communication methods. At first, the counselor offered the veteran the options of visiting the office or calling the main office number. However, when the veteran attempted to use these communication channels, he was met with unanswered phone calls and an abrupt change in the counselor's attitude, discouraging him from visiting the office. 

Worse, in an attempt to delegitimize the veteran's efforts to establish communication and request a change of counselor, Mr. Mauricio Solis has threatened the veteran with calling the VA Police and Federal Protective Services, if the veteran continues to reply to emails initiated by Mr. Mauricio Solis. Such threats are not only unfounded, but they also serve to escalate the situation, creating a greater barrier to resolution and preventing the veteran from accomplishing his goal to obtain gainful employment.  (Mr. Mauricio Solis also mentions that the veteran has been ‘flagged’ by VHA for ‘disruptive behavior’ if you, Mr. Paz, have any confidence in such allegations, let us, by agreement, make a request for VHA to review the situation regarding its legitimacy. ) 

Previously, the veteran had an experience where this same counselor accused him of missing a scheduled appointment, when, it was the counselor who had left the office, fully aware that the veteran was on his way. This incident was the triggering event for the veteran's request to change his counselor. 

Following the veteran's attempts to reach the supervisor, you, Mr. Francisco Paz, responded on July 6th, stating that the request would be considered, and that a decision would be notified to the veteran after your return from annual leave on July 18th. Yet, as of today, July 24th, the veteran has received no resolution or satisfactory update on this matter. Meanwhile, the veteran’s plans for gaining employment remain stagnant. 

In light of the above, I respectfully request your immediate attention and intervention in this matter. The veteran is simply seeking assistance in line with the VR&E's mandate and should not have to endure such unprofessional conduct. I urge you to take swift action to rectify this situation, including the appointment of a new counselor, and consider measures to ensure such incidents do not occur in the future.

UPDATE #1

Since July 5th, I requested a change of counselor, a request denied by Mr. Francisco Paz, the supervisor of VR&E counselor Mr. Mauricio Solis, on or around July 25th. Although I respect this decision, I fundamentally disagree with it. Given this denial, it is crucial that I continue to document our situation as a safeguard against any arbitrary decisions from Mr. Solis.

These gentlemen, Mr. Paz and Mr. Solis, fundamentally, lack the autonomy over the decisions they make. After careful examination of available documents, spanning years of interactions with VA employees, I've understood that they simply follow directives from higher authorities.

My criticisms of the AFGE Union are well-known. As this union essentially holds sway over VA staff, it's my firm belief that the union's leadership is the driving force behind the irresponsible actions by Mr. Solis, to include Mr. Paz's refusal to grant my request for a counselor change. Mr. Paz and Mr. Solis seemingly cannot refuse the union's directives for fear of jeopardizing their livelihoods and those of their families. This power dynamic within the VA offers a plausible explanation for the pattern of misconduct evident in the documentation, which, incidentally, is available for the Secretary of Veterans Affairs to review.

Lastly, I want to stress that when a veteran requests a change of counselor or physician, this request should be honored. Failure to do so seemingly endorses further maltreatment of the veteran by VA employees under the influence of the AFGE Union. I sincerely hope that the Secretary will take note of this.

I hope this letter finds you well. I am writing to bring your attention to an incident that transpired recently involving Mr. Mauricio Solis, a VR&E counselor in your department.

On June 30, 2023, I had an appointment with Mr. Solis, to which I arrived promptly at 3 PM as per my earlier communication. However, I was informed by the receptionist that Mr. Solis had left for the day, despite it being within his stated office hours of 7:30 AM to 4:30 PM. On arrival at my home, I discovered an email from Mr. Solis, indicating that he had cancelled our appointment due to my supposed absence.

The communication issue and the mismatch in understanding are concerning and pose questions about the professionalism and accountability within your office. This incident, I believe, forms part of a larger pattern of irregularities that have a negative impact on the department's operational process and overall efficiency, as well as my ability to achieve my goal of obtaining a job in IT.

I kindly request you, as Mr. Mauricio Solis's supervisor, to review this situation thoroughly. I believe your insights and understanding will be essential in determining whether this conduct aligns with the leadership and organizational values we uphold in the VR&E office.

I also respectfully request that you devise a plan to correct this issue to prevent similar situations from recurring in the future. It is crucial that we maintain a professional and reliable service for all parties involved, ensuring trust and credibility within the workplace.

Lastly, I would appreciate if you could provide me with a documented copy of your corrective action plan. This will not only assure me of your commitment to addressing this issue but will also help reinforce my confidence in your leadership to manage such situations effectively.
