Infinity Travels inserted a phone number 1-805-751-2794 in the top of the results of an internet search for United Airlines when I was in Eastern Europe. It was NOT for UA, but I did not know it. It was NOT a link. The results for UA and phone numbers I could call from Europe was very confusing. This phone number was the first scam.
When I called the phone number, the guy who called himself Nicholas did not identify his office. This was the second scam. When you call a business and the first thing they say is "Hello" or "How can I help you", ask "Who am I talking to" or confirm in some other way what business they are. This was the second scam.
There were transportation labor strikes in Germany for 2 days, Thursday and Friday, at the time I was traveling. No planes were taking off. I was due to fly through Germany on Sunday. I thought I was going to be fine. But I tried calling UA just to confirm my reservation on UA. The first things that happened was "Nicholas" put me on hold.
When he came back, he stated unequivocally that the labor strikes were continuing into the next week until Wednesday. I really needed to be home by Sunday. So he immediately struck fear into me of being stranded. This was the third scam. The strikes were only 2 days. Being struck by this shocking information, I forgot the reason for my call: to confirm my reservation on UA. I should have remembered this, and gone back to this question.
"Nicholas" offered me a plane ticket on a "partner" airline for $1,193 to fly home on a different airline which I purchased and used on Saturday. When I got the invoice and saw "Infinity Travels," I knew I had been scammed - it was not UA. But I still didn't know that the labor strikes were only 2 days.
When I got home, I looked up Infinity Travels on the internet and saw many complaints against them, including the BBB. I filed a complaint with the BBB, but they shut down the complaint before there was a resolution (there's a reason they can claim "most disputes closed within 30 days" - they don't see complaints through to the end - they just shut it down after contacting the company once or twice - they are the Better BUSINESS Bureau, not the "Better Consumer Advocate Bureau"). Infinity offered a refund of "booking fees," but they did not say how much that was, even though I wrote to Infinity AND the BBB asking for this information. The BBB shut down the matter before this information was given and would NOT take another complaint to find out how much the booking fee was.
Then I researched filing a small claims court case against Infinity in Orange County, CA. I was required to make a demand to Infinity before I could file. I sent a certified letter to the registered agent (available on the CA Secretary of State web site), the other owner (available on the BBB web site), and the business address. I got a response from someone calling himself "Dave Brown" (although it seems like it was someone else, possibly the registered agent or owner). We traded emails. At the end of every one of my emails, I made a demand of $2,041 within a certain date (2 or 3 weeks) or else I would file in small claims. In getting a remedy from a company, you always have to prepare as if you're going to court. I calculated my losses fairly and added $1000 for the emotional and physical distress they caused me.
"Dave Brown" offered $586 to settle, so I sent an agreement to settle for that amount in exchange that they would agree to use their phone number 760-999-7119 (the number on their web site) always in connection with identification of their business name and that they would advertise their business only with making their independent status known, and that they would identify their business name to everyone who contacted them by phone or email. I told them that if they operated openly, fairly, honestly, and with transparency, they should have no problem with this agreement. Instead of agreeing to this, and tacitly admitting they operated with misrepresentations and unethically, unfairly, and with deceptive business practices which were my claims against them, they offered me $2,041 to settle, which I accepted.
Infinity sent me a cashier's check. I deposited it with my bank after telling the bank this was settlement for a dispute over a scam, and my bank put a 10 day hold on the check just to be sure it would clear which it did.
So it IS possible to get your money back (1) if you can find a registered agent and (2) if you prepare your case to go to small claims court on your own (just research the laws of the state the company is in).
Going to a lawyer is not helpful - I used to work for lawyers - they take your money, don't do anything on your case (just ignore you unless you're spending $50k with them), they charge you their hourly rate for every 6 minutes they do something on your case (including talking or emailing with you), and then you don't get a resolution without charging you more money. If a lawyer takes your case on contingency basis and you get a settlement (say $10k), the lawyer gets 30% or 40% of the settlement (say $3k or $4k), taxes take 33% ($3,300), and you get what's left over (say $3k or $4k) when you could do it on your own and get the full settlement amount.
When you make a demand to a company, you have to craft your demand clearly without emotion and by the rules of the law. State the facts, and make a reasonable demand. Demand your settlement amount and tell the company you will file in court if you don't hear from them within a certain amount of time. I am not a lawyer and cannot give legal advice.
