Ion Solar False Advertising Denver Colorado

A]    Background:

I was born in Korea, and my command of the English language is very limited.  I read and write the Korean language and not the English language.

 On 12/24/2023 a door to door salesman from ION Solar stopped by my house and he made a solar presentation to me in which he alleged (a) thousands of dollars in saving guaranteed by switching to solar, (b) all financial charges will be waived If I signed up today, (c) zero monthly utility bills after the solar system is installed; guaranteed,  (d) no maintenance cost to me for 25 years, (e) no system depreciation and that the system annual production will stay the same for 25 years, guaranteed, (f) that the sale price of  $17,058.00 is the lowest price that ION Solar has ever offered to any customer, but that I must sign up TODAY because that special price is only good for today, and (g) that I am free to shop around and that if I can find a better offer I can always cancel without any cancellation fees and without any cost to me, guaranteed. 

I told the ION person that I do not read the English language and I asked him to wait until I can find someone to read and to translate to me the ION Installation Agreement before I sign, but he refused and he insisted that I must sign today, so I did but honestly, I could not read or understand what I was signing.   See (Exhibit A).

As of March 25, 2024, ION Solar has not installed any solar equipment on my house.  Further, as of March 25, 2024, I have not received any thing of any value from ION Solar, nothing at all.

B]    ION Agreement is Voided - Fraudulent Inducement:

On or around March 25, 2024, and upon further research, I have discovered that {MOST} of the claims that the ION person alleged were FALSE and pure fabrication.

Had I known the truth and had I known the facts regarding the ION Solar system on 12/24/2023 I would have never signed any agreement with ION Solar, and I would have never entered into any agreement with ION Solar.

 i- Here, the law is very clear, because there were multiple misrepresentations during the sales process, these misrepresentations constituted fraudulent inducement, which did void the ION contract, meaning that no terms in the contract would be enforceable, including the cancellation penalty.

 ii- Further, the ION contract is also voided because ION Solar forced me to sign a document (the contract) which I was not able to read or understand. I only read and write the Korean language and not the English language. ION Solar knew that, yet they insisted on me signing the Solar agreement anyway.

C]    Breach of Contract, Threats & Harassments:

On page # 7 of the ION contract, it clearly states that I have the right to arbitration to review my claims against ION. See (Exhibit B).

On March 25, 2024, I sent an overnight “Notice of Dispute” to ION Solar asking for Arbitration, which they received on March 26, 2024.  See (Exhibit C).

Instead of ION Solar honoring their OWN terms of the agreement, and instead of Ion Solar initiating an arbitration process; instead, they immediately violated their own arbitration rule by immediately giving me an ultimatum, either install their solar system immediately, or I will be penalized with a $3,500.00 cancellation penalty, and they just simply ignored my right to arbitration review! See (Exhibit D) This is just another example of how shady ION Solar is.
